அன்புடையீர்,

கொள்கை பிரகடனமும் சமாதான நடவடிக்கையும்

இலங்கையின் ஜனாதிபதியாக தாங்கள் தெரிவு செய்யப்பட்டமைக்கு எனது பாராட்டுதல்களை முதற்கண் தெரிவித்துக்கொள்கிறேன். நாம் இருவரும் 1970ம் ஆண்டு ஏக காலத்தில் பாராளுமன்றம் சென்றோம். சபை உறுப்பினர்களில் மிகவும் இளவயதினராகிய தங்களுக்கு கௌரவ ஸ்டான்லி திலகரட்னா அவர்களை சபாநாயகராக பிரேரிக்கும் கௌரவம் கிடைத்தது. பாராளுமன்றத்தில் சமகாலத்தில் இருந்த போதும் வயதால் நான் உங்களிலும் பார்க்க 12 ஆண்டுகள் மூத்தவர் என்ற காரணத்தால் 25ம் திகதி பாராளுமன்றத்தில் தாங்கள் ஆற்றிய கொள்கை பிரகடன உரையில் தங்களுக்கு நன்மை பயக்கக்கூடிய வகையில் சில மாறுபட்ட கருத்துக்களை நான் கூற விரும்புகிறேன். வழமைபோல் கடந்தகால ஜனாதிபதிகள் நவீன இலங்கையை கட்டியெழுப்ப அனைவரினதும் உதவியை வேண்டியது போல் தாங்களும் கேட்டுள்ளீர்கள். அதிருப்தியுடன் வாழும் சிறுபான்மை மக்களின் ஒத்துழைப்பை பெறாது அந்த இலக்கை அடைவது மிகவும் கடினமானதாகும். பெரும்பான்மை சிங்கள மக்களின் முழு ஒத்துழைப்பு கூட தங்களுக்கு கிடைக்காது போகலாம். ஏனெனில் இன்று இலங்கை மக்களின் ஒரே குறிக்கோள் சமாதானத்தை பெறுவதே. அதை அடைவதற்கு நியாயமான ஏற்றுக்கொள்ளக்கூடிய தீர்வு அவசியமானதாகும்.

சமாதானம் எமது வீட்டுப்படிவரை வந்துள்ளவேளை அதை ஏற்பதா அன்றி நிராகரிப்பதா என்பது தங்களிடமே தங்கியுள்ளது. பிரிவினையை ஆதரிக்காத சர்வதேச சமூகத்துக்கு ஏற்புடையதான ஐக்கிய இலங்கைக்குள் ஒர் நியாயமான தீர்வை முன்வைத்துவிட்டு புதிய இலங்கையை உருவாக்கும் பணிக்கு நீங்கள ஆதரவு திரட்டலாம். அதுவரை நீங்கள் எதை இலவசமாக கொடுப்பினும் சிறுபான்மை இனத்தினர் எதிலும் அக்கறைக்காட்ட மாட்டார்கள். இதை தெளிவாக கூறின் விடுதலைப் புலிகள் அவர்களை எதற்கும் அனுமதிக்கமாட்டார்கள். திருப்திகரமான சமிக்ஞை தங்கள் பக்கத்தில் இருந்து வரும்வரை எதற்கும் விடுதலைப் புலிகளின் அழுத்தத்திற்கு கட்டுப்பட்டு ஒடுங்கி வாழ்வதை தவிர வேறு வழியில்லை.

அனேகர் எண்ணுவது போல் ஜனநாயகம் என்பது பெரும்பான்மையினரின் ஆட்சியல்ல. சிறுபான்மையினரின் ஒத்தாசையுடன் பெரும்பான்மையினரால் நடாத்தப்படுவதே உண்மையான ஜனநாயகமாகும். ஆங்கில அகராதி ஜனநாயகத்துக்கு பின்வருமாறு விளக்கம் தருகிறது. ஜனநாயகம் என்பது நேரடியாக அல்லது பிரதிநிதிகள் மூலமாக எல்லா மக்களாலும் நடத்தப்படும் அரசாகும். - பாரம்பரிய பிரிவுகள் அற்ற சமுதாயம் - சிறுபான்மையினரின் கருத்துக்கு மதிப்பளித்தல் போன்றவையாகும். கடந்த ஜனாதிபதி தேர்தலில் எதிர்கட்சித் தலைவர் கௌரவ ரணில் விக்கிரமசிங்க அவர்கள் பெற்ற அத்தனை வாக்குகளும் தங்களுக்கு எதிராக அளிக்கப்பட்ட வாக்குகள் அல்ல, என்ற தங்களின் கூற்றை நானும் ஏற்றுக் கொள்கிறேன். எம் மத்தியில் நிரந்தர அதிருப்தியுடன் வாழும் சிறுபான்மை மக்கள் குறிப்பாக தமிழ், முஸ்லீம் மக்களோடு இணைந்து எவ்வாறு புதிய இலங்கையை உருவாக்கப் போகிறீர்கள்?

ஐக்கிய இலங்கைக்குள் சமஷ்டி ஆட்சி முறையை உருவாக்கி இனப்பிரச்சினைக்கு தீர்வு காண்பதாக கூறிய கௌரவ ரணில் விக்கிரமசிங்க அவர்களுக்கு 49 வீதமான மக்களின் வாக்குகள் கிடைத்துள்ளது. இதே சமஷ்டி தீர்வு முறையை தங்களுடைய கட்சியாகிய SLFP கட்சியும் ஏற்றுக்கொண்டுள்ளது. இடதுசாரி கட்சிகள் தங்களுக்கு வாக்களித்ததாக தாங்கள் ஏற்றுக் கொண்டால் ஐக்கிய இலங்கைக்குள் சமஷ்டி அடிப்படையிலான தீர்வை அமுல்ப்படுத்த தங்களுக்கு அமோகமான மக்கள் ஆணை கிடைத்துள்ளது எனக் கொள்ளலாம். இது சமஷ்டி அடிப்படையிலான தீர்வை அமுல்ப்படுத்த மக்களுடைய கருத்துக் கணிப்புக்கும், அரசியல்சாசன திருத்தத்துக்கும் வேண்டிய மூன்றில் இரண்டு தேவைக்கு போதுமானதாகும். எனது கருத்தை ஏற்றுக் கொள்ளாது போனாலும்கூட சமஷ்டி கொள்கையை ஆதரித்த 49 வீதமான மக்களை இலகுவாக புறக்கணிக்க முடியாது.

ஜாதிக ஹெல உருமய கட்சியையோ அல்லது ஜே.வி.பி யையோ நான் தனிமைப்படுத்தவில்லை. இவ்விரு கட்சித் தலைவர்களுடன் நான் பலசுற்று பேச்சுக்கள் நடத்தியுள்ளதால் இவ்விரு கட்சிகளின் நிலைப்பாட்டை தெளிவுப்படுத்த விரும்புகிறேன். ஜனாதிபதித் தேர்தல் பிரச்சார காலத்தில் ஜாதிக ஹெல உருமய தாம் இந்திய முறையிலான அதிகார பகிர்வை ஏற்பதாக கூறியுள்ளனர். இவ்விடயத்தை தங்களின் கவனத்துக்கும் கொண்டு வந்துள்ளேன். ஜே.வி.பி கூட விடுதலைப் புலிகள் தனிநாட்டுக் கோரிக்கையை கைவிடும் பட்சத்தில் தமது தீர்மானத்தை மறுபரிசீலனை செய்வதாக கூறியுள்ளனர். ஜே.வி.பி யின் பொதுச் செயலாளர் திரு. ரில்வின் சில்வா அவர்களுக்கு நான் எழுதிய கடிதத்தின் ஒரு பகுதியை கீழே தருகிறேன். இந்த சந்தர்ப்பத்தில் கூறுவது பொருத்தமானதாக இருக்கும் எனக் கருதுகிறேன்.

“இனப்பிரச்சினையில் எல்லா பிரிவினைரையம் ஒன்று சேர்த்து பொதுவானதொரு தீர்வை எடுக்க வேண்டிய பொறுப்பை இன்றைய இளைய சமூகத்தினர் ஏற்க வேண்டும். நாளுக்கு நாள் இனப்பிரச்சினை தீர்வுக்கு சமஷ்டி முறையே சிறந்தது என்ற கருத்து மக்கள் மத்தியில் வளர்ந்து வருகிறது. இனப்பிரச்சினை தீர்வுக்கு 50 ஆண்டுகளில் முதற் தடவையாக பிரதான அரசியல் கட்சிகள் சமஷ்டி முறையை தீர்வாக தேர்தல் பிரச்சாரத்தில் முன் வைத்துள்ளன. ஐ.தே.க, எஸ்.எல்.எப்.பி ஆகியவை ஏற்கனவே தமது முடிவை அறிவித்துள்ளன. இடதுசாரி கட்சிகள் என்றும் இந்தக் கருத்தையே ஆதரித்து வந்துள்ளன. ஜாதிக ஹெல உருமய கூட இந்திய முறையை ஏற்பதாக தெரிகிறது. தங்களுடைய கட்சியாகிய ஜே.வி.பி கூட விடுதலைப் புலிகள் தனிநாட்டுக் கோரிக்கையை கைவிட்டால் மறு பரிசீலனை செய்வதாக கூறியுள்ளது.

இந்திய முறையிலான அதிகாரப்பகிர்வு இலங்கையின் பல்வேறு தர மக்களுக்கு ஏற்புடையதாக தோன்றுகிறது. சரித்திரத்தில் பெரும் தவறை செய்ததாக இல்லாமல் ஜே.வி.பி யும் நல்லதோர் தீர்வை எடுக்க வேண்டும். ஒவ்வொருவரும் விரைவில் ஒரு தீர்வு ஏற்படுவதையே விரும்புவதால் ஒன்றுபட்ட தீர்வு எடுக்கப்படின் ஜனாதிபதி தேர்தலின் பின் ஏனைய விபரங்களை பேசித் தீர்த்துக் கொள்ளலாம். பிரிவினையை நடைமுறைப்படுத்த முடியாது என விடுதலைப் புலிகள் உணர்ந்து அக் கோரிக்கையை அவர்கள் கைவிட வேண்டும். சர்வதேச சமூகமோ, இந்தியாவோ பிரிவினையை ஏற்கப் போவதில்லை. இந்தியாவின் இந்த எதிர்ப்பு இத்தகைய பிரிவினை கோரிக்கை தமது நாட்டிலும் எழாது தவிர்ப்பதற்குமாகும் எனக் கருதுகிறேன். சமஷ்டி முறை நாட்டுப் பிரிவினைக்கு வழிகோலாது என உறுதியாக கூறுகிறேன். அதற்கு மாறாக நாட்டை ஒற்றுமைப்படுத்த அது உதவும். ஐக்கிய இலங்கைக்குள் தீர்வு காண்பதையே தாம் விரும்புவதாக சர்வதேச சமூகமும் தெளிவாகக் கூறியுள்ளது.”

நாட்டின் பொது நன்மை கருதி அனைவரும் விரும்பும் சமாதானத்தை இந்திய முறையிலான அதிகாரப் பகிர்வை ஜே.வி.பி யை ஏற்க வைக்க முடியுமென நான் வலுவாக நம்புகிறேன். 25 மாநிலங்களை உள்ளடக்கிய இந்தியா பிரிவினையை பற்றி பேசுவதில்லை. தமது ஆட்சி முறையை சமஷ்டியோ, ஒற்றையாட்சியோ என்று கூட அவர்கள் அலட்டிக் கொள்வதில்லை. வேற்றுமையில் ஒற்றுமை என்ற கோட்பாட்டை இந்தியர்களிடம் இருந்து நாம் கற்றுக் கொள்ள வேண்டும். இந்தியா உட்பட சர்வதேச சமூகம் பிரிவினையை ஆதரிக்கப் போவதில்லை என்று பல தடவைகள் கூறியுள்ளன. எமது பெரும் அயல் நாடான இந்தியாவின் இந்த நிலைப்பாட்டை நாம் புறக்கணிக்க முடியாது. இதை விடுதலைப் புலிகளும் உணர்ந்து கொள்ள வேண்டும்.

இனப்பிரச்சினைத்தீர்வுக்கு தங்களுக்கு கிடைத்துள்ள பெரும் மக்கள் ஆணையும் பிரிவினையை தடுப்பதற்கான உத்தரவாதமும், துணிச்சலான முன்னெடுப்புக்கு தங்களுக்கு உதவும். மேலும் பேச்சுவார்த்தையை காலம் கடத்துவது புத்திசாலித்தனம் அல்ல. பிரச்சினை என்ன? அதற்குத் தீர்வு என்ன? என்பதை நாம் அறிந்ததே. விடுதலைப் புலிகள் தமது பிரிவினைக் கொள்கையை மாற்றிக் கொள்ளப் போவதில்லை. நியாயமற்ற விஷமத்தனமான பிரச்சாரத்தையே உலகம் முழுவதிலும் மேற்கொண்டு வருகின்றனர். இலங்கையிலும் பிற நாடுகளிலும் வாழும் சிறார்கள் மூளை சலவை செய்யப்படுகிறார்கள். பெரும் எதிர்ப்பின்றி உலகிலுள்ள சகல தமிழ் ஊடகங்கள் அவர்களின கட்டுப்பாட்டிலேயே இயங்குகின்றன. ஒற்றையாட்சி, கூட்டாட்சி, சமஷ்டி ஆகிய வார்த்தைகளில் தொங்கிக்கொண்டு சமாதான முயற்சியை தாமதப் படுத்துவதன் மூலம் சர்வதேச சமூகத்துக்கு அதிருப்தி ஏற்பட்டு விடுதலைப் புலிகளால் செய்யப்படும் அரசுக்கு விரோதமான பிரச்சாரங்களை கண்டும் காணாமலும் இருக்க வேண்டிய நிலைமை ஏற்படும்.

பல நாடுகளில் தடை செய்யப்பட்ட இயக்கமாக இருந்தும் கூட விடுதலைப் புலிகள் பல்வேறு நாடுகளில் எம் மக்களிடம் பலாத்காரம், அச்சுறுத்தல் மூலம் பெருந்தொகையான பணத்தை சேகரிக்கின்றனர். பிரதிபலிப்புக்கு பயந்து யாரும் அதிகாரிகளிடம் முறையிடுவதில்லை. அவர்களின் கட்டுப்பாட்டில் உள்ளுர் சட்டங்களை மீறி பணம் சேர்க்கும் வழிமுறைகளை கையாளும் பல்வேறு அமைப்புக்கள் இயங்குகின்றன. பல நாடுகள் தம் மக்களின் நடவடிக்கைகளில் தலையிடுவதில்லை. அடிப்படை உரிமைகளில் தலையிடுவதாக குற்றம் சுமத்தப்படுவதை அவர்கள் விரும்பவில்லை. ஆகவே அரசு நியாயமான தீர்வை எடுப்பதற்கு விசுவாசமாக செயல்படுகின்றது என்பதை உலகுக்கு தெரியப்படுத்தினால்தான் சர்வதேச சமூகம் விடுதலைப் புலிகளின் நடவடிக்கைகளை கட்டுப்படுத்தும். எமது பிரச்சினையை தீர்ப்பதற்கு அவர்களுடன் நாம் ஒத்துழைக்காவிட்டால் அவர்கள் ஏன் எம்மைப்பற்றி கவலைப்பட வேண்டும்?

இனப்பிரச்சினை ஆரம்பித்து 50 ஆண்டுகள் ஆகிவிட்டன. 1956ம் ஆண்டு தனி சிங்களச்சட்டம் உருவாக்கப்பட்ட போது ஆரம்பித்த இனப்பிரச்சினை பண்டா- செல்வா ஒப்பந்தத்தின் மூலம் தீர்த்திருக்க முடியும். 10 ஆண்டுகளின் பின் டட்லி-செல்வா ஒப்பந்தம் மூலம் தீர்வு கண்டிருக்க முடியும். 1996 ம் ஆண்டு ஜனாதிபதி சந்திரிகா பண்டாரநாயக்கா குமாரதுங்கா அவர்களால் முன்வைக்கப்பட்ட அரசியல் யாப்பு மூலம் தீர்த்திருக்க முடியும். முதல் தடவையாக சமஷ்டி முறையில் தீர்வு காணும் ஆலோசனை கடந்த தேர்தலில்தான் முன்வைக்கப்பட்டுள்ளது. தங்களுடைய அமைப்புக்குள் உள்ள தடைகளை தாண்டி செயல்படுவீர்களானால் இந்திய முறையிலான தீர்வை முழு நாட்டின் ஒத்துழைப்போடு அடைய முடியும்.

இந்த நிலைப்பாட்டை நான் எடுப்பதால் எனக்கு ஏற்பட்டுள்ள அச்சுறுத்தலை தாங்கள் அறிவீர்கள். எனது ஆலோசனை இந்த நாட்டினதும், மக்களினதும் அமைதியிலும், முன்னேற்றத்திலும் சகலரும், சம உரிமையுடன் வாழ வேண்டும் என்ற நல்லெண்ணமும் கொண்ட ஒருவரால் முன் வைக்கப்படுவதாக நீங்கள் ஏற்றுக் கொண்டால் எதுவித தாமதமுமின்றி மக்களின் உற்சாகம் குறையு முன்பு இப் பிரச்சினைத் தீர்வுக்கு நடவடிக்கை எடுக்க வேண்டும். தாமதம் பாதகமாக முடியும். ஆகவே உடன் செயற்படுங்கள். மக்களின் முழு ஆதரவும் தங்களுக்கு உண்டு.

Your Excellency,

POLICY STATEMENT AND THE PEACE PROCESS

May I take this opportunity first to congratulate you on your election as President of Sri Lanka. Both of us entered Parliament together in 1970 and you being the youngest of all had the Honour of proposing Hon Stanley Thilagaratne to be the speaker.

Although both of us are of the same seniority in Parliament I being elder to you by 12 years, take the liberty to make some adverse comments benefitial to you, on your Policy statement to Parliament on the 25th As usual like your predecessors, you too have sought the co-operation of everyone to help you to build a New Sri Lanka. Without a contended minority support it is difficult to achieve it. Even the full co-operation of the majority Sinhalese may not be available to you because the main concern of the people of Sri Lanka today is achieving Peace and to achieve it an acceptable solution is a pre- requisite. Peace is knocking at our door. Whether we are going to let it in or shut our doors is in your hands. Having found a reasonable solution, within the frame- work of a United Sri Lanka, acceptable to the International Community which will never support separation, you can then proceed to muster support for the creation of a New Sri Lanka. Until then the minorities are not at all interested in anything even if you give them everything free . To put it better the LTTE won’t allow them to do anything. With no satisfactory response from your side, they have no alternative other than submitting themselves to the LTTE’s pressure for everything.

Democracy is not, as many people think, merely rule of the majority. Real Democracy is rule of the majority with the consent of the Minority. The Concise Oxford Dictionary defines Democracy as follows:- “Government by all the people, direct or representatives, form of society ignoring hereditary class distinctions, and tolerating minority views”. I agree with you that all the votes received at the last Presidential Elections by the Leader of the Opposition Hon.Ranil Wickramasinghe are votes cast against you. How are you going to build up a New Sri Lanka with the permanently disgruntled minority groups in our midst, the Tamils and Muslims?

You are aware that over 49% of the voters had approved Hon. Ranil Wickramasinghe’s “Federalism within a United Sri Lanka as a solution to the ethnic problem. You are also aware that your own political Party, the Sri Lanka Freedom Party too has accepted “Federalism” as a solution to our ethnic problem. If you accept that all the supporters of your party, the SLFP and other Leftist Parties like the LSSP, CP, MEP etc. too had voted for you, then you have got a Massive Mandate from the people of Sri Lanka to solve the problem based on a federal structure, within a United Sri Lanka. This may meet even the 2/3rd requirement for amending the constitution and to go for a referendum on the Federal Solution. Even if you disagree with me, you can’t overlook the claims of the 49% of the people who had voted openly for a Federal solution.

I am not trying to isolate neither the JHU nor the JVP. I am dealing with them separately since I have had several rounds of talks with the leaders of these two parties. During the Presidential Election campaign the JHU had declared their acceptance of the Indian pattern of devolution. I think I brought this fact to your notice. The JVP too have stated that if the LTTE gives up its demand for separation they too will reconsider their earlier decision. The following is a portion of a letter addressed to the Secretary of JVP Mr. Tilvin Silva by me, which appears to be relevant, at this juncture.

“The present day youths should take the responsibility on themselves and unite all forces to arrive at a consensus on the ethnic issue. The demand for Federalism as a solution to the ethnic problem is gaining ground day by day. For the first time in fifty years major political parties in Sri Lanka are putting forward Federalism, as an election pledge, to solve the ethnic problem. The UNP and the SLFP have already declared their stand. The Left Parties had always supported it. It appears that the JHU also is favouring an Indian pattern of devolution.

I understand that your party Jathika Vimukthi Peremuna has declared that if the LTTE gives up its demand for separation they will also reconsider their earlier decision.

The Indian pattern of devolution seems to be acceptable to all sections of the people of Sri Lanka. I earnestly plead with the JVP also to take an early decision on this matter without making a historic blunder. Everyone wants a solution early and if a consensus is arrived at, then after the Presidential Election is over, the details of the solution can be worked out. The LTTE should now realize that separation is not possible and give up its demand for separation. Neither the International Community nor India will approve separation. India’s disapproval will be mainly due to avoiding a similar demand within itself. I can assure with confidence that a federal solution will never lead to a division of the country. Instead it will keep the country united. The International Community has made it very clear that they would like a solution within a united country.”

I am strongly of the view that the JVP too can be persuaded to accept the Indian Pattern of devolution, in the larger interest of the country and to achieve much desired Peace. India with 25 states within do on talk about separation. They also do not bother whether it is a federal state or a unitary state. They have reached Unity in Diversity, a lesson we Sri Lankans should take from India. The International Community including India had repeatedly declared that they will not support separation. The concerns of India our big neighbour cannot be ignored and the LTTE too should take serious note of it.

With the massive mandate you have to solve the ethnic problem and with sufficient guarantees against division of the country, you should not hesitate to take a bold step towards finding a solution. I do not think, it is wise to spend any more time in discussion. We know the problem and what the solution is. The LTTE will never change their stand on separation. The type of campaign they do all over the world is very vicious and unjustifiable. The Tamil children both in Sri Lanka and abroad are brain washed. The LTTE controls both the Tamil Electronic and Print media all over the world with hardly any opposition. If the Sri Lankans and the Sri Lankan Government continue to delay the Peace Process by clinging on to one word Unitary or United or Federal, we only earn the displeasure of the International Community which will be compelled to be indifferent to any type of campaign by the LTTE against the Sri Lankan Government.

Inspite of its ban in several countries the LTTE continues to collect large sums of money from the expatriate Tamils all over the world mostly under compulsion and threat. The expatriate Tamils dare not complain to the authorities for fear of reprisals. They have a number of front organizations under their control to find ways and means of dodging the local laws under which collection of funds is unauthorised . Most countries do not interfere unnecessarily in the activities of their people. They are very careful about being accused of violating their fundamental rights. It is therefore your duty to show the world that your government is taking honest efforts to find a reasonable solution, for the International Community to check the activities of the LTTE in the respective countries. If we do not cooperate with them to help us to solve our problem, why should they bother about our problem?

The ethnic problem is now fifty years old. The problem started with the passage of Sinhala only Act of 1956, could have been solved if the Banda -Chelva Pact had been implemented. Ten years later Dudley-Chelva Pact could have solved it if implemented. The proposal of President Chandrika Bandaranaike Kumarathunga of 1996 could have solved it, if due co-operation was given. For the first time in the History of the ethnic problem “Federalism” had been offered as a solution to the ethnic problem. If you clear the little hurdle you face in your group you will have the support of the entire country with hardly any opposition to solve the problem on the Indian pattern.

You are aware what amount of risk I face for taking this stand. If you accept my proposal as one coming from a person who is genuinely interested in Peace and progress of the country and its People and also wanting everybody to enjoy equal rights, please take the initiative to solve this pressing problem without any delay, before the enthusiasm dies. I advice you, that delay will be detrimental. Therefore act now and the People will give you full backing. I will be too happy to meet you and brief you further.

My dear Tylvin,

I need not remind you of the cordial relationship I had with all the members of your group in Parliament. Even the rank and file of your party hold me at high esteem-not without a cause. This attitude of all of you towards me is obviously due to the trust you have in me and in my policies. I strongly believe in building a Sri Lankan Society based on Liberty Equality and fraternity. Every citizen of this country should feel that he or she is freely enjoying equal rights with the others and living with the fellow citizens like brothers. I am convinced that none of you or your supporters would like to dominate members of other ethnic groups. Neither you want to enjoy more rights than the other groups nor wish to sow seeds of discord among various communities. This is why I as a leader of a minority ethnic group look at you from a different perspective.

I am perhaps the only one Tamil leader who do not see you as a group spreading hatred among various ethnic groups. Your Party has a clean record of having not harmed a single Tamil or a Muslim. Not even a stone had been thrown on them. No inflammatory speeches had been made to promote dissension among various communities. Yet your party is branded as a communal party opposed to the other minority groups. The damage is done by some Tamil media directly or indirectly controlled by the L.T.T.E. They do not hesitate to condemn everyone apposed to the views held by the LTTE.

Most people do not know that I am a founder member of the Tamil United Liberation Front (TULF) that was responsible for adopting a resolution at its convention in 1976 for the creation of a separate state for Tamils called “Eelam”. Soon after adopting that resolution our leader declared that “If a viable alternative is offered, the TULF if satisfied with it, will take it to the People for their approval”.

For the benefit of the younger generation and to refresh the memories of the older ones, I wish to state that the said resolution was adopted under compelling circumstances to show the Government that if a solution was not found, the only option Tamils had was to think of separation. The ethnic problem in Sri Lanka gained momentum with the passage of the Sinhala Only Act. The Banda-Chelva pact or five years later the Dudley-Chelva pact would have solved our problems, if not disrupted. The Government’s proposal of 1996 also met with the same fate. After fifty years of agitation we are back to square one. A country that should have been peace-full and a paradise on earth is in shambles and with no hopes of a bright future.

I do not want to blame one party or the other. We must leave it in the hands of the younger generation to find a solution. The present day youths are more educated and more enlightened. They do understand the high principles of Democracy. They know what discrimination means. They should feel for the pitiable condition in which displaced people are living in camps for over fifteen years. The Muslims sent out of the North are living in more than 125 refugee camps in the Puttalam and Anuradhapura districts. Tamils in the North and East living within LTTE held areas do not enjoy even their basic rights. The suffering of the displaced Sinhalese also is a factor that cannot be ignored.

The present day youths should take the responsibility on themselves and unite all forces to arrive at a consensus on the ethnic issue. The demand for Federalism as a solution to the ethnic problem is gaining ground day by day. For the first time in fifty years major political parties in Sri Lanka are putting forward Federalism, as an election pledge, to solve the ethnic problem. The UNP and the SLFP have already declared their stand. The Left Parties had always supported it. It appears that the JHU also is favouring an Indian pattern of devolution.

I understand that your party the Jathika Vimukthi Peremuna has declared that if the LTTE gives up its demand for separation they will also reconsider their earlier decision.

The Indian pattern of devaluation seems to be acceptable to all sections of the people of Sri Lanka. I earnestly plead with the JVP also to take an early decision on this matter without making a historic blunder. Every one wants a solution early and if a consensus is arrived at then after the Presidential election is over, the details of the solution can be worked out. The LTTE should now realize that separation is not possible and give up its demand for separation. Neither the International community nor India will approve separation. India’s disapproval will be mainly due to avoiding a similar demand within itself. I can assure with confidence that a federal solution will never lead to a division of the country. Instead it will keep the country united. The International Community has made it very clear that they would like a solution within a united country.

In conclusion I wish to point out that with your party also deciding to support the Indian pattern of devolution, this proposal will receive the support of a very large section of the people of Sri Lanka. If you fail to take a decision in favour of the proposal early it will be a great disappointment for many, with no hopes of a solution for many more years. Let the future generation not curse us for missing a golden opportunity that came on our way with large majority of the people of Sri Lanka agreeing for an amicable settlement of our problem. As for me, like many others, I am also getting disgusted with the manner in which various parties deal with this issue, which has brought ruin to the country and its people.

I trust your party will take a favourable decision before the election and make an announcement accordingly. I am available to you anytime if you want to discuss this matter with me

APPEAL TO THE PRESIDENTIAL CANDIDATES BY V.ANANDASANGAREE, PRESIDENT-T.U.L.F.

When the country is facing a crucial election, that will determine the fate of our country and its various ethnic groups I have a bounden duty to speak on behalf of the Tamil people of the North and the East, who have no proper representatives either in Parliament or outside. Those Tamils who are representing the North and the East in Parliament are only proxies of the L.T.T.E. with no independent views and those outside have been silenced by the threat of guns. As far as the North and the East are concerned the last free and fair election was held on the 5th of December, 2002 at which I polled over 36,000 votes and came first out of the nine Members elected from the Electoral District of Jaffna. Therefore I have an undisputable right to speak on their behalf.

Wide publicity was given in the local papers to the letters I sent to the two main Presidential Candidates urging them not to include the “Ethnic Issue” in their election campaign. It being the most urgent and important of all issues, and being a sensitive one, should be dealt with separately. I also expressed the fear that the ethnic issue may take a communal turn during the election campaign. Communalism long dead may be revived.

Initiative should be taken by the Prime Minister Hon.Mahinda Rajapakse and the Leader of the Opposition Hon.Ranil Wickramasinghe to arrive at a consensus before the election, on the “Ethnic Issue” in consultation with the other Political Parties supporting them and take it forward jointly after the elections, the winner taking the initiative and with the support of the others. The advantage in this process would be that all those who are parties to the consensus arrived at, could take it as a mandate given to them by the voters at the election. A formula that I have to solve the ethnic problem, had been discussed with leaders of many political parties, the Mahanayakas and Senior Politicians. I have made it know to the Rt. Rev Bishops and many other religious dignitaries also.

On the “Ethnic Issue” I can speak more authoritatively being one of the most Senior Tamil Politician living today. I know the history of the ethnic problem which gathered momentum only with the passage of the Sinhala only Act of 1956. The problem could have been solved with the Bandaranayake-Chelvanayakam pact or five years later with the Dudley-Chelvanayakam pact. Both pacts were disrupted. I do not want to blame one party or the other, but the fact remains that no one can find a solution to our problem after the election. Having known the fate of the B-C pact, the D-C pact and the draft constitution of 1996. I declare without any hesitation that the promise of both the main candidates in respect of the ethnic issue can never be fulfilled.

It is encouraging to see that Federalism as a solution to our problem is being discussed all over the country and has been placed before the People at a very crucial election. For the first time in the Island’s history a major political party the U.N.P. has pledged to solve the ethnic problem after the elections, based on Federalism within a United Sri Lanka. Another major political party the S.L.F.P. too has decided to find a solution based on Federalism. The Left parties had already accepted Federalism as a solution. I have had a number of meetings with the J.V.P. Leaders and had discussed various aspects of Federalism. They too had stated that if the L.T.T.E. openly declares to give up their demand for separation, they are also prepared to reconsider their stand. During a series of meetings I had with the Leaders of the J.H.U. we discussed the Indian pattern of devolution also. Above all during the past two years, a lot of speeches had been made with in Parliament and outside, suggesting Federalism as the only solution. There had been a number of Workshops and Seminars on Federalism, organized by a number of N.G.OO.

The late Hon.S.W.R.D.Bandaranayake, long before he became Prime Minister, was the first to suggest a Federal solution, foreseeing the problems the country would face in the future. The late President J.R.Jeyawardana also had said that Federalism is the best solution for our problem. Unfortunately he said it after retirement Hon.Bob Rae the Ex-Premier of Ontario in Canada, an expert in Federalism had said more than once that Federalism is the best solution. Not to mention names, a lot of leaders belonging to various political parties also had agreed that Federalism will solve our problems easily. The enthusiasm shown by most leaders and religious dignitaries had given me so much of encouragement to get actively involved in canvassing support for a solution based on Federalism.

The fear that a federal solution will end up in separation is groundless. First of all a separate state can never be achieved. Secondly the International Community had said that the only solution should be within a united Sri Lanka and that they will never support a separate state. India had also repeatedly said that it will not support division of the country. India tackled a similar problem in Tamil Naad over fifty years back and no one now talks about separation. All minority groups in Tamil Naad are leading a contended life.

Those who fear that Federalism will lead to separation must be satisfied with India’s Stand and accept it as a guarantee. If the fear of separation still persist the other ideal alternative is to accept an Indian Pattern of devolution. The Indian pattern could be sold easily to our people rather than any other system which will be new to them. Thousands of Sri Lankans who fly to several destinations in India every day, see for themselves how the Indian system works.

One of the largest Democracies is our immediate neighbour India. We should take a lesson from them. The country with the largest Hindu population in the world has a Muslim scientist as the Head of the State and the Indians are very proud about it. The Prime Minister who commands very high respect in India belongs to a community which is only 2% of its population. We, whether Sinhalese, Tamils or Muslims all came from India. Our languages culture and two of our religions are of Indian origin.

In spite of the threats and humiliation I suffered, I spent the last two years in canvassing support for a permanent solution by devolution of power based on the Indian pattern. During the past two years I did not find a single person opposed to my proposal within Sri Lanka or outside. This proposal will be acceptable to all Tamils and Muslims. If the majority of the Sinhalese also agree, a solution to our problem is at our door step. I am not acting as an agent of India which does not bother as to what system we adopt or reject.

No one can deny the fact that the Tamils, Muslims and Sinhalese in the North and the East are the real victims of war. They are the people who live in constant fear and tension. Arbitrary arrests, detentions, extortions, abductions, tortures, intimidations, disappearances, recruitment of children continue to take place un-challenged. It is true and rather very unfortunate that twenty to thirty thousand Sinhalese and Muslim village youths from poor families who joined the army to earn a living died in the battle front-- a loss that cannot be compensated. On the other hand due to some administrative blunder a couple of thousand innocent Tamil people also got killed. In addition to this over eighteen thousand(18,000) Tamil youths sacrificed their lives in the battle field. Good number of them are children of poor families. Above all many thousand innocent ones got killed in bomb blasts during the last 20 years. Those responsible for the war are responsible for the loss of 60-70 thousand valuable lives and for the creation of thousands of widows, orphans and cripples. No one wants war except those who are blood thirsty and can’t live without smearing their hands in human blood. A real patriot will not want a single person to die unnecessarily whether he is a Tamil, Muslim or Sinhalese.

Tsunami brought all the three communities together. We have heard Sinhalese, Tamils and Muslim saving the lives of those in distress without any communal differences. We have seen Sinhalese women carrying food parcels on their heads and shoulders walking several miles to feed people of other communities in distress. This is the proud tradition of our country. No Sinhalese or Tamil or a Muslim will rejoice at the down fall of one another. Whether we are Buddhist, Hindus, Christians or Muslim, our religions preach the same thing. With a very few exception, the Sinhalese, Tamils and Muslims like to live like children of the same family. Every one is aware of the sufferings of the Tamils of the North and the East. What every Sinhalese should ask himself is whether it is not his duty to liberate the Tamils, which is possible only if some Sinhalese Leaders come down and extend their hands of friendship to the Tamil people and win their confidence.

A description of the pitiable plight of the Tamils and Muslims living in the North and the East, briefly given here should not fail to touch the hearts of the Members of the J.V.P. and the J.H.U. I strongly urge the leadership of both parties with whom I had a series of discussions on the ethnic issue, to re-consider their present stand and agree for a Federal Solution within a United Sri Lanka. If still reluctant, as an alternative, the Indian pattern of devolution should be considered. It is difficult to convince the minorities, who are the real victims of war, if a reasonable solution is not offered. When a consensus is arrived at that proposal can be submitted to the L.T.T.E. for them to request any changes if they so desire.

If any one is serious in solving the problem a gentlemen’s agreement should be entered into, to agree for a federal solution or even for a settlement based on the Indian Pattern of devolution by the main contenders. As suggested by me to both the main Presidential Candidates by my letter of 2nd October if that issue is taken out of the election campaign and put forward as a common programme all the votes obtained by both candidates could be taken as a mandate given for the implementation of the Agreement. Without any reservations I say that the Leader of the Opposition soliciting the support of the S.L.F.P after the election and the Prime Minister promising to have direct talks with the L.T.T.E. Leader to solve the ethnic problem, within three months after the election, are all day-dreams and will never take place. We will go back to square one. This is what happened repeatedly at all elections in the past. History is repeating itself.

I strongly plead with the L.T.T.E. also to give up its demand for separation which can never be achieved, and to accept a solution based on the Indian pattern of devolution. I am certain that peace is at our door-step. Taking it in or chasing it out is in their hands.

TRAVEL BAN AND THE PROTEST RALLY IN BRUSSELS

I am writing this in reference to a news item regarding the L.T.T.E. ordering its front organisations in the countries of the European Union to organise a protest rally in Brussels on 24th October, to demand the immediate lifting of the “Travel Ban” imposed on them by the E.U. The L.T.T.E. that is holding Sri Lanka to ransom is now trying to extend its terror and intimidation to the E.U. Countries and very soon to the entire world. In response to the call of the L.T.T.E. a number of people are preparing to participate in the proposed rally from Europe, U.K. and Scandinavian countries. Most of the would be participants are either citizens or permanent residents of the countries where they reside and are enjoying all benefits including the education of their children. Most of them have sponsored and got down their parents and close relatives too. These are the people who finance the L.T.T.E. for all their activities including the training of children for war.

If you take into consideration the numerous violations of the Ceasefire Agreement by the L.T.T.E. and their denial of basic human rights to the Tamil People, forcibly kept by them under their subjugation, for many years, the sanctions imposed so far by the E.U. is very mild. It is the provisions in the C.F.A. that enabled them to enter into the areas under the control of the Government. Although their entry into these areas was limited to only 50 and 100 during the first two months, from the 3rd month they came into Government areas in very large numbers and today they are controlling almost all such areas- the North in particular. The people who had been enjoying all the rights in those areas have now been deprived of many of their basic rights. Hardly one day passes without at-least one person getting killed in these areas. Politically motivated killings, arbitrary arrests, harassments, abductions, detentions, torture, extortions, intimidation, disappearances and conscriptions are some of the many fundamental right violations of the L.T.T.E, still going on unabated.

Inspite of these nefarious activities they have not failed to get the best advantage out of the C.F.A. Hundreds of them who dared not to enter in to the Government controlled areas, before the C.F.A. was signed, could until the travel ban was imposed go abroad freely with Government security and helicopters provided, to go to the Airport. Large number of unchecked baggages were also transported at Government expense. They did not fail to exploit the Norwegean Facilitators who paid for their passages, provided hotel accommodation and arranged seminars and high level meetings with officials of various countries.

Since the C.F.A. was signed 3 years and 8 months back, a number of Diplomats and V.I.PP. who visited them had advised them very many times to stop killing people and recruitment of child soldiers. These are the two matters every body stressed on, although there are many matters for which the L.T.T.E. could have been found fault with. They did not heed any such advice and continued with the killings and conscriptions, even after the imposition of the “Travel Ban”, which could be construed as a challenge to the International Community, the E.U. in particular.

On Monday the 16th of August, 2004 the Local E.U. Troika comprised of H.E. Mrs.Susan.Th.Blankhart, H.E. Mr.Stephen Evans and H.E Mr.Wouter Wilton the Ambassador for Nertherlands, High Commissioner for U.K. and Charge‘ d’ Affaires of the E.U. respectively met Mr.Thamilchelvan and advised him to stop this.

On 12th August, 2004 a statement, issued by Mr.Adam Erell on behalf of the Deputy Secretary H.E. Mr.Armitage says that having reviewed the situation with the U.S. Ambassador in Sri Lanka H.E. Mr.Jeffrey Lunstead he had said that assassinations and suicides bombings are unacceptable, and that the recruitment of child soldiers must cease.

At a Press Conference in Colombo on 8th March 2005 E.U. Commissioner Ferrero Waldner had said, “I made clear my readiness to meet the L.T.T.E. Leaders, but for logistical reasons this has not been possible on this occasion. The messages I would have passed are the following. The L.T.T.E. must Renounce violence, Respect the Ceasefire Agreement, Resolve their commitment to principles stated in Oslo Declaration of December, 2002 to find a Federal Solution within a United Sri Lanka, Stop recruitment of children, and Give breathing space in the North and East to political parties and people who have a different opinion.

The above three references are sufficient to justify the E.U.’s decision to impose Travel Ban on the L.T.T.E. as a first steps before taking harsher steps.

I appeal to the International Community to go all out to prevent such a rally being held in Brussels which is in fact to demand from the E.U. the right for the L.T.T.E. to kill those who do not agree with them and to recruit children as child soldiers. The would be participants at this rally may be politely told, if they so desire, to return to the L.T.T.E. held areas with their wives and children. They may be also told that in a Democracy “Sole Representation” concept will never fit in and that it will better fit in only in a fascist state. The modern democracies can’t be polluted by fascist elements and the only option the E.U. has, is to proscribe the L.T.T.E. in the E.U. This is the most opportune time for the International Community to liberate the Tamils from the L.T.T.E.

It is very unfortunate that the TNA Members of Parliament who claim the L.T.T.E. as the “Sole Representatives” of the Tamils people, have not condemned neither the recruitment of children nor any killings including the latest killings of Principals of two leading colleges in Jaffna. Some TNA MPP are also planning to take part in the rally in Brussels.

இந் நாட்டினதும் அதில் வாழும் பல்வேறு இன மக்களினதும் தலைவிதியை நிர்ணயிக்கப்போகும் ஓர் மிக முக்கியமான தேர்தல் நடைபெறவுள்ள இந்த நேரத்தில் வடக்கு கிழக்கு மாகாண மக்கள் சார்பில் பேசுவதற்கு பாராளுமன்றத்திலோ அல்லது வெளியிலோ முறையான யாரும் இல்லாத இச்சந்தர்ப்பத்தில் அம் மக்கள் சார்பில் பேச வேண்டிய தார்மீக கடமை எனக்குண்டு. வடக்கு கிழக்கு மக்களை பாராளுமன்றத்தில் பிரதிநிதித்துவப்படுத்தும் பிரதிநிதிகள் சுயமாக இயங்குவதற்கு தகுதியற்று விடுதலைப் புலிகளின் பினாமிகளாகச் செயற்படுகின்றனர். ஏனையோர் துப்பாக்கியின் பயம் காரணமாக அமைதியாக இருக்கின்றனர்.

வடக்கு கிழக்கை பொறுத்தவரையில் 2002 ம் ஆண்டு மார்கழி 5ம் திகதி நடைபெற்ற தேர்தலே நீதியாகவும், சுதந்திரமாகவும் நடைபெற்ற கடைசித் தேர்தலாகும். அத் தேர்தலில் யாழ் தேர்தல் மாவட்டத்தில் தெரிவான ஒன்பது உறுப்பினர்களில் 36,000 மேலாக வாக்குகளைப் பெற்று முதலாவதாக தெரிவு செய்யப்பட்டவன் நான் என்பதால் எம் மக்கள் சார்பில் பேசும் உரிமை யாராலும் பிரச்சினைக்குட்படுத்தக்கூடியதல்ல.

இனப் பிரச்சினையை தேர்தல் பிரச்சாரத்துக்குட்படுத்த வேண்டாமென இதற்கு முதல் இரு முக்கிய ஜனாதிபதித் தேர்தல் வேட்பாளர்களையும் வற்புறுத்திக் கேட்டுக் கொண்டதை உள்ளுர் பத்திரிகைகளும் பிரசுரித்திருந்தன. அப்பிரச்சினை மிக அவசரமானதும் முக்கியமானதும் மட்டுமன்றி மிக உணர்வூட்டக்கூடியதுமான பிரச்சினையானதால் அது தனிமைப்படுத்தி பேச வேண்டிய பிரச்சினையாகும். தேர்தல் பிரச்சாரம் முன்னெடுக்கப்படும் போது இப் பிரச்சினை முடிந்து போன இனவாதத்தை தூண்டக்கூடிய ஒன்றாக மாறலாம் எனவும் எச்சரித்திருந்தேன். தம்மை ஆதரிக்கும் கட்சிகளுடன் ஆலோசித்து இனப்பிரச்சினை தீர்வில் ஓர் பொது நிலைப்பாட்டை தேர்தலுக்கு முன்பே எடுத்து தேர்தல் முடிந்தபின் வெற்றி பெற்றவர் ஏனையோரின் ஒத்துழைப்பைப் பெற்று தீர்வை நோக்கி முன்னெடுக்க வேண்டுமென பிரதமர் மகிந்த ராஜபக்ஷவையும், எதிர்கட்சித் தலைவர் ரணில் விக்கிரமசிங்கவையும் கேட்டிருந்தேன்.

இத்திட்டத்தில் நன்மையாதெனில் இவ் ஆலோசனையை ஏற்று போட்டியிடும் வேட்பாளர்கள் அனைவரும் கூட்டாக பெறும் வாக்குகளை மக்கள் அத்திட்டத்தை ஏற்றுக் கொண்டனர் என்பதை உறுதிப்படுத்தும் மக்கள் ஆணையாக கொள்ளலாம். இனப்பிரச்சினைத் தீர்வுக்கு நான் வைத்திருக்கும் தீர்வானது பல்வேறு அரசியற் கட்சி தலைவர்களுடனும், வணக்கத்துக்குரிய மகாநாயக்கா தேரர்களுடனும, மூத்த அரசியல் தலைவர்களுடனும், பல்வேறு சமய தலைவர்களுடனும் பேசியுள்ளேன். என் நிலைப்பாட்டை அதி வணக்கத்துக்குரிய ஆண்டகைகளுக்கும் தெரியப்படுத்தியுள்ளேன்.

இன்று வாழும் மூத்த தமிழ் அரசியல் தலைவர்களுள் நானும் ஒருவன் என்ற முறையில் இப்பிரச்சினை சம்பந்தமாக பேசும் அதிகாரமுடையவனாவேன். 1956ம் ஆண்டு தனிச்சிங்களச் சட்டம் உருவாக்கப்பட்ட பின்புதான் நம் பிரச்சினை சூடு பிடித்தது. இப் பிரச்சினையை பண்டா-செல்வா ஒப்பந்தம் மூலம் அன்றே தீர்த்திருக்க முடியும். அல்லது ஐந்து ஆண்டுகளுக்குப் பின் டட்லி-செல்வா ஒப்பந்தத்தின் மூலம் தீர்த்திருக்க முடியும்.

இரு ஒப்பந்தங்களும் குழப்பப்பட்டன. இதற்கு நான் எந்தக் கட்சியையும் குறைகூறவில்லை. ஆனால் உண்மை எதுவெனில் இப் பிரச்சினைக்கு தேர்தல் முடிந்தபின் தீர்வு காண்பதென்பது யாராலும் முடியாத காரியமாகும். பண்டா-செல்வா ஒப்பந்தம், டட்லி-செல்வா ஒப்பந்தம் , 1996 இல் முன் வைக்கப்பட்ட அரசியல் சாசன நகல் முதலியவைகளுக்கு என்ன நடந்தது என்ற சரித்திரத்தை நன்கு அறிந்தவன் என்பதால் எதுவித தயக்கமின்றி இவ்வ்pரு பிரதான வேட்பாளர்களும் இனப்பிரச்சினை தீர்வு சம்பந்தமாக அறிவித்துள்ள வாக்குறுதிகள் என்றும் நிறைவேற்ற முடியாதென அடித்துக் கூற முடியும்.

எமது இனப்பிரச்சினைத் தீர்விற்கு சமஷ்டி முறையே சிறந்தது என நாடு பூராகவும் பேசப்படுவதும், இத்தீர்வை தேர்தல் மூலம் மக்கள் முன் வைக்கப்பட்டுள்ளமையும் உற்சாகத்தை தருகின்றன. இத் தீவின் சரித்திரத்தில் ஒரு பிரதான அரசியற் கட்சியான ஐக்கிய தேசிய கட்சி தேர்தலின் பின் சமஷ்டி அடிப்படையில் இனப்பிரச்சினைக்கு தீர்வு காண்பதாக கூறியுள்ளது. அதே நிலைப்பாட்டை சுதந்திரக்கட்சியும் எடுத்துள்ளது. இடதுசாரி கட்சிகள் இனப்பிரச்சினைத் தீர்விற்கு சமஷ்டி முறையே சிறந்தது என ஏற்கனவே தீர்மானித்து விட்டன. சமஷ்டி முறை பற்றி ஜே.வி.பி உடன் நான் பல தடவை பேசியுள்ளேன். புலிகள் பிரிவினை கோரிக்கையை கைவிடும் பட்சத்தில் தாம் தமது நிலைப்பாட்டை மாற்றிக் கொள்வோம் எனக் கூறியுள்ளனர். ஜாதிக ஹெல உருமயவுடன் நடத்தப்பட்ட பல சந்திப்புக்களில் இந்திய முறை போன்ற அதிகாரப் பரவல் சம்பந்தமாக பேசிக் கொண்டோம். எல்லாவற்றிற்கும் மேலாக கடந்த இரு ஆண்டு காலமாக பாராளுமன்றத்தின் உள்ளும் வெளியிலும் இனப்பிரச்சினை தீர்விற்கு சமஷ்டி முறையே சிறந்தது எனப் பேசப்பட்டு வருகிறது. பல்வேறு அரச சார்பற்ற நிறுவனங்களும் கலந்துரையாடல்களும், பயிற்சி வகுப்புக்களும் நடாத்தி வருகின்றன. பிரதம அமைச்சராவதற்கு முன்பே ளு.று.சு.னு பண்டாரநாயக்கா அவர்கள் நாட்டில் எதிர்காலத்தில் ஏற்படக்கூடிய பிரச்சினையை முன் கூட்டியே உணர்ந்து சமஷ்டி ஆட்சி முறையை அமுல்படுத்த வேண்டும் என தனது விருப்பத்தை தெரிவித்தார். காலஞ்சென்ற முன்னாள் ஜனாதிபதி ஜே.ஆர். ஜெயவர்த்தனா கூட எமது பிரச்சினைத் தீர்விற்கு சமஷ்டி முறையை சிபாரிசு செய்திருந்தார். துரதிஷ்டவசமாக காலம் கடந்து, இளைப்பாரிய பின்பே இக்கருத்தை வெளியிட்டார். சமஷ்டி ஆட்சி முறையில் மிகப் பெரும் அனுபவம் பெற்று இருந்த கனடா நாட்டின் ஒன்றாரியோ பிரதமர் பொப் றே (டீழடி சுயந) கூட இனப்பிரச்சினைத் தீர்விற்கு சமஷ்டி முறையே சிறந்தது என பல தடவைகள் கூறியுள்ளார். பெயர் குறிப்பிடாமல் கூறின் பல்வேறு அரசியல் கட்சிகளை சேர்ந்த தலைவர்கள் அனைவரும் அவ்வாறே கூறியுள்ளனர். பல்வேறு தலைவர்கள் சமயப் பெரியார்கள் காட்டிய உற்சாகமே இனப்பிரச்சினை தீர்விற்கு சமஷ்டி முறையே சிறந்தது என என்னை தீவிர பிரச்சாரத்தில் ஈடுபட வைத்தது.

சமஷ்டி முறை நாட்டுப் பிரிவினைக்கு வழிகோலும் என்ற கருத்து ஆதாரமற்றதாகும். முதலாவதாக தனியரசு அமைப்பது என்பது நிறைவேறக்கூடியதல்ல. இரண்டாவதாக சர்வதேச சமூகம் ஒன்றுபட்ட இலங்கைக்குள்ளேயே எதுவித தீர்வும் ஏற்பட வேண்டும் என்றும், பிரிவினையை ஆதரிக்கப் போவதில்லை எனவும் பல தடவை வெளிப்படையாகக் கூறியுள்ளது. 50 ஆண்டுகளுக்கு மேல் தமிழ் நாட்டில் இத்தகைய ஓர் பிரச்சினை ஏற்பட்ட போது இந்திய அரசு வெற்றிகரமாக அப்பிரச்சினையை தீர்த்தது. இப்போது எவரேனும் பிரிவினையை பற்றி பேசுவதில்லை. இன்று சிறுபான்மை சமூகத்தைச் சேர்ந்த அனைவரும் திருப்தியோடு வாழ்ந்து வருகின்றனர்.

சமஷ்டி முறையால் நாடு பிளவுபடும் என்ற பயம் கொள்வோர் இந்தியாவின் நிலைப்பாட்டில் திருப்தி அடைந்து அதை ஓர் உத்தரவாதமாக ஏற்றுக் கொள்ள வேண்டும். மேலும் பயம் ஏற்படின் இந்திய ஆட்சி முறைக்கு ஒத்த அதிகார பரவல் வழங்குவதை மாற்றுத் திட்டமாக ஏற்றுக்கொள்ள வேண்டும். வேறு புதிய திட்டங்களிலும் பார்க்க அத்தகைய திட்டம் எமது மக்களுக்கு ஏற்புடையதாகும். இந்தியாவின் பல்வேறு பகுதிகளுக்கு தினமும் பிரயாணம் செய்யும் ஆயிரக்கணக்கான இலங்கை மக்கள் இந்திய ஆட்சி முறையை நேரடியாக கண்டும் வருகின்றனர்.

உலகிலேயே மிகப் பெரிய ஜனநாயக நாடு, அயல் நாடாகிய இந்தியாவாகும். அவர்களிடம் நாம் கற்க வேண்டிய விடயங்கள் உண்டு. மிகப்பெரிய அளவிலான இந்துக்களை கொண்ட நாடு ஒரு இஸ்லாமிய விஞ்ஞானியை ஜனாதிபதியாக நியமித்து பெருமை கொள்கின்றது. அந் நாட்டின் இரண்டு வீத மக்களை கொண்ட ஒரு சமூகத்தைச் சேர்ந்த ஒருவர் பெரிதும் மதிப்போடு இருக்கும் பிரதம மந்திரியாவார். தமிழர்கள், முஸ்லீம்கள், சிங்களவர்கள் ஆகிய நாம் கூட இந்தியாவில் இருந்து வந்தவர்களே. எமது மொழிகள் கலாச்சாரம் பிரதான இரண்டு சமயங்களும் இந்தியாவை சேர்ந்தவை.

இந்திய முறைப்படியான அதிகார பகிர்வின் மூலம் எமது பிரச்சினைக்கு நிரந்தர தீர்வு காண வேண்டும் என பல்வேறு மிரட்டல்கள், அவமதிப்புக்களுக்கு மத்தியில் ஆதரவு தேடி கடந்த இரண்டு ஆண்டுகளாக பிரச்சாரம் செய்து வருகின்றேன். இலங்கைக்கு உள்ளேயோ அன்றி வெளிநாட்டிலோ கடந்த இரண்டு ஆண்டு காலமாக எனது பிரேரணையை எவரும் எதிர்க்கவில்லை. இவ் ஆலோசனை சகல தமிழ், முஸ்லீம் மக்களுக்கு ஏற்புடையதாக இருக்கும் பெரும்பான்மையான சிங்கள மக்களும் இவ் ஆலோசனைக்கு ஆதரவு கொடுப்பின் பிரச்சினைகுத் தீர்வு அதிக தூரத்தில் இல்லை. நான் ஒரு இந்திய முகவராக செயற்பட வில்லை. எம் பிரச்சினையை எவ்வாறு தீர்க்க போகிறோம் என்பது பற்றி இந்தியா அலட்டிக் கொள்ளப் போவதில்லை.

வட கிழக்கில் வாழும் தமிழ், முஸ்லீம் சிங்கள மக்களே இந்த யுத்தத்தினால் பெரிதளவு பாதிக்கப்பட்டனர். இவர்களே நிரந்தர பயத்துடனும், பீதியுடனும், வாழ்கின்றனர். முறையற்ற கைதுகள், தடுத்து வைத்தல், பணம் பறித்தல், ஆட் கடத்தல்கள், சித்திரவதை, மிரட்டல், காணாமல் போதல், யுத்தத்திற்கு சிறுவர்களை சேர்த்தல் போன்றவை எதுவித தடையுமின்றி நடைபெற்று வருகின்றது. 20 ஆயிரத்துக்கும், 30 ஆயிரத்துக்கும் இடைப்பட்டவர்கள் வயிற்றுப் பிழைப்புக்காக இராணுவத்தில் சேர்ந்த ஏழை கிராமபுற சிங்கள , இஸ்லாமிய மக்களின் பிள்ளைகள் யுத்த முனையில் கொல்லப்பட்டமை உண்மையில் வேதனைக்குரியதும் ஈடு செய்ய முடியாத இழப்புமாகும். சில நிர்வாக சீர்கேடு காரணமாக அப்பாவி தமிழர்கள் இரண்டாயிரத்துக்கு மேற்பட்டவர்கள் கொல்லப்பட்டும் இருக்கிறார்கள். அதN;தாடு 18000 இற்கு மேற்பட்ட தமிழ் இளைஞர்கள் யுத்த முனையில் உயிரை பலி கொடுத்துள்ளனர். அவர்களில் அனேகர் கட்டாயத்தின் நிமிர்த்தம் சேர்க்கப்பட்ட சிறுவர்கள. எல்லாவற்றுக்கும் மேலாக கடந்த 20 ஆண்டுகளில் நடைபெற்ற குண்டு வெடிப்புக்களில் பல்லாயிரக்கணக்கான அப்பாவி தமிழ் மக்கள் உயிரிழந்துள்ளனர். 60, 70 ஆயிரம் அப்பாவி பொது மக்களின் மரணத்திற்கு பொறுப்பேற்க வேண்டியவர்கள் யுத்தத்திற்கு காரணமானவர்களே. பல ஆயிரக்கணக்கான விதவைகள், அநாதைகள் ஊனமுற்றோர் உருவாக்கப்பட்டுமுள்ளனர். இரத்த வெறி பிடித்தவர்களும், தம் கைகளை இரத்தத்தில் தோய்த்து எடுக்க விரும்புகிறவர்கள் மட்மே அன்றி மற்றவர்கள் யுத்தத்தை விரும்ப மாட்டார்கள். . ஒரு நாட்டுப் பற்றாளன் தமிழரோ, இஸ்லாமியரோ, சிங்களவரோ, எவரேனும் ஒருவர் அநாவசியமாக இறப்பதை விரும்ப மாட்டான்.

நாட்டில் வாழும் மூன்று பிரதான இனங்களை சுனாமி ஒன்று சேர்த்து வைத்தது இன, மத வேறுபாடின்றி ஒருவருக்கு ஒருவர் ஒத்தாசையாக ஆபத்தில் சிக்கியவரை காப்பாற்றியுள்ளனர். சிங்கள பெண்கள் உணவுப் பொட்டலங்களை தலையிலும், தோளிலும் சுமந்து சென்று வேறு இனத்தை சேர்ந்த அகதிகளுக்கு ஊணவூட்டியமையை அறிந்தும் இருக்கின்றோம். இச் செயல் எமது நாட்டின் பெருமை மிக்க பாரம்பரியமாகும். ஒரு சிங்களவரோ, தமிழரோ, முஸ்லீமோ இன்னொருவரின் வீழ்ச்சியை கண்டு மகிழ்ச்சியடைய மாட்டார். நாம் பௌத்தர்களாக, இந்துக்களாக ,இஸ்லாமியர்களாக இருந்த போதும் அம் மதங்கள் எல்லாம் ஒன்றையே போதிக்கின்றன. ஒரு சிலரைத் தவிர தமிழ், சிங்கள இஸ்லாமிய மக்கள் அனைவரும் ஒரு குடும்பத்தைச் சேர்ந்த சகோதரர்கள் போல் வாழ விரும்புகின்றனர். வடக்கு கிழக்கில் வாழ்கின்ற தமிழ் மக்களின் துன்பங்களை பலரும் அறிந்துள்ளனர். ஒவ்வொரு சிங்களவரும் தமிழர்களை மீட்டெடுக்க வேண்டிய கடமைப்பாடு தமக்கு உண்டா இல்லையா என்பதை தம்மைத்தானே கேட்க வேண்டும். தமிழ் மக்களுக்கு தம் நேசக்கரத்தை நீட்டி நல்லுறவை வளர்ப்பதன் மூலமே இதை சாதிக்க முடியும்.

வடக்கு கிழக்கில் வாழும் தமிழ் முஸ்லீம் சகோதரர்களுடைய

சுருக்கமாக இங்கே கூறப்பட்டுள்ள உள்ளத்தைத் தொடும் சோக சம்பவங்கள் நிச்சயமாக ஜே.வி.பி, ஜாதிக ஹெல உருமய போன்ற கட்சி உறுப்பினர்களின் உள்ளத்தை தொடும் என்று நான் நினைக்கின்றேன். பல சுற்றுப் பேச்சுவார்த்தை என்னோடு நடத்திய இவ்விரு கட்சிகளின் தலைமைகள் இனப்பிரச்சினை சம்பந்தமாக தமது நிலைப்பாட்டை மறுபரிசீலனை செய்து ஒன்றுபட்ட இலங்கைக்குள் சமஷ்டி ஆட்சி முறையை ஏற்கும்படி கேட்டுக்கொள்கின்றேன். இப்போதும் இவர்கள் இதற்கு சம்மதிக்காவிட்டால் இதற்கு மாற்றாக இந்திய அரசியல் சாசனத்தை ஒத்த அதிகாரப்பகிர்வை கண்டிப்பாக பரிசீலிக்க வேண்டும்ஃ உண்மையான யுத்த அகதிகளாகிய சிறுபான்மையினருக்கு நியாயமானதொரு தீர்வை முன்வைக்காது திருப்திபடுத்துவது கஷ்டமாக இருக்கும். எல்லோரும் ஒத்தபடி ஓர் நல்ல தீர்வை எடுப்பின் அதை விடுதலைப் புலிகளின் பரிசீலனைக்கு முன்வைத்து அவர்கள் விரும்பின் ஏதாவது மாற்றங்கள் எவையென் அறிந்து கொள்ளலாம்.

இனப்பிரச்சினைக்கு தீர்வு காண வேண்டும் என யாரும் உண்மையில் விரும்பினால் சமஷ்டி ஆட்சி முறையை ஏற்று அல்லது இந்திய அரசியல் சாசனத்தின் அதிகாரப்பகிர்வை ஏற்று போட்டியிடும் இரு பிரதான வேட்பாளர்களும் ஓர் கனவான்கள் ஒப்பந்தம் செய்து கொள்ள வேண்டும். அக்டோபர் 2ம் திகதி இவ்விரு பிரதான ஜனாதிபதி வேட்பாளர்களுக்கு நான் எழுதிய கடிதத்தில் குறிப்பிட்டது போல் இப்பிரச்சினை தேர்தல் பிரச்சாரத்தில் உட்படுத்தாமல் ஒரு பொதுத் தீர்வாக இருவரும் முன் வைத்து போட்டியிட்டால் இவ்விருவரும் பெறும் வாக்குகள் மூலம் இத் தீர்வுத் திட்டத்தை அமுல்படுத்த மக்களின் அங்கீகாரம் கிடைத்ததாக கருதலாம். எதிர்கட்சித் தலைவர் தேர்தல் முடிந்தபின் ஸ்ரீலங்கா சுதந்திரக்கட்சியுடன் பேசி இனப் பிரச்சினைக்கு தீர்வு காண்பதாக கூறுவதும், பிரதம அமைச்சர் தேர்தலின் பின் மூன்று மாதத்துக்குள் விடுதலைப் புலிகளின் தலைவருடன் பேசி தீர்ப்பதாக கூறுவதும் பகல் கனவே அன்றி என்றும் நடக்கக்கூடிய காரியமல்ல. புறப்பட்ட இடத்துக்கே திரும்பவும் திரும்ப வரவேண்டிய நிலை ஏற்படும். திரும்பத் திரும்ப தேர்தல் காலத்தில் இப்படி நடப்பது வழமையாகி விட்டது.

என்றும் அடைய முடியாத தனிநாட்டுக் கோரிக்கையை கைவிட்டு இந்திய அமைப்பை ஒத்த அதிகாரப் பகிர்வை ஏற்றுக் கொள்ள வேண்டும் என்று விடுதலைப் புலிகளை கேட்டுக்கொள்கிறேன். சமாதானம் வந்து எமது வீட்டுக் கதவை தட்டுகிறது. சமாதானத்தை வீட்டுக்குள் எடுப்பதா விரட்டியடிப்பதா எனத் தீர்மானிக்க வேண்டியது விடுதலைப் புலிகளே.

My dear Commissioner.

CONDUCT OF POLL IN THE NORTH AND THE EAST.

Once again you have been entrusted with the difficult task of holding an election, this time electing the President of Sri Lanka. Although you succeeded in holding a Free and Fair election, to a great extent in all parts of Sri Lanka, it was a miserable failure in the North and the East, for which I do not blame you. Since you were not empowered to annul the election in respect of an Electoral District the Government should have taken the initiative either to hold a fresh poll to the North and the East or a repoll in the entire country. The number of seats involved being 22 is not a small number to be ignored.

I have a number of witnesses, very creditable too, to prove that the Returning Officer his assistant, the Senior and Junior Presiding Officers, a host of other officials assigned election duty, NGOO, Members of some Monitoring Teams, high religious Dignitories and such others had been briefed by L.T.T.E. Leaders on ,as to how poll should be conducted. I don’t find fault with anyone of them for attending such meetings under threat, but people with such responsibilities should have brought this matter to your notice without conniving with one another to conduct a fraudulent election, committing a serious crime of treason. Since all staff on election duty in the North were all Tamils the L.T.T.E. found it easy to compel them to connive and act as instructed by them.

I am one who respects you as a very honest officer who will conduct this election impartially and make it free and fair in the North and the East also. Please ensure that whoever gets elected as President is by the free will of the people. If the bad precedent created at the last Parliamentary Election in the North and East is repeated at this election too it will be difficult to mend in the future. The Tamil Public Servants who conducted the election in the North and East should take the blame for failing to protect the rights of the Tamil people who are not free to decide on their own. Hence without entrusting the task to the same set of Government servants kindly have Government servants of all communities mixed so that if the Returning Officer is a Tamil the Deputy is a Sinhalese or Muslim and every polling station must have the Senior Presiding Officer or the Junior Presiding Officer (JPO) and half or one third of the officials assigned election duty should be either Sinhalese or Muslim.

For mysterious reasons the police did not do any election duty other than maintaining Law and order and therefore the assistance of the Security Forces was not reguested. The impersonators had a free day going about with bundles of genuine and forged Polling Cards in a number of vehicles from one Polling Station to the other, men casting women’s votes and women men’s votes. The requirement is only possession of a Polling Card and the capacity to identify a symbol. The police simply looked on while voting went on smoothly. I hope you yourself would have been shocked to hear all these. Let it not happen again. I understand 5000 police officers are due to be transferred from the North and the East to the South. Please have these transfers cancelled and also empower the security forces to do election duty without the condition, to give help only if asked for. Please see that all vehicles other than those commissioned by the Returning Officer for election duty and public transport, are kept in doors with orders to arrest any vehicle seen on the road. Very frequent patrolling is also necessary and every junction should have a set of Police or Army officers to check vehicles and to identify persons seen with Polling Cards.

Sri Lankan Democracy is peculiar to Sri Lanka only, since a voter who has the tight to vote need not know or see the person to whom he is voting or knowing what his policies are. The Vanni people has lost so many democratic rights. Voting for a person without knowing anything about him is not going to do any good for him. Further more he is not sure whether he will be voting direct or by proxy. He would rather stay at home without voting. Hence don’t establish cluster polling stations unless an identity card of any from is insisted on for a voter to leave Vanni and to come in to the cleared area to vote. Unlike last time the polling booths should be in cleared area with full security for agents of candidates to canvas support, among the voters which too though irregular will be better than last time. During the last Parliamentary Elections the T.N.A. under the pretex of performing street dramas all over the Kilinochchi District characterized me in a demeaning manner showering heaps of allegations about me.

What is the protection a candidate has if an announcement is made in Vanni that a candidate had withdrawn from the contest. This happened to me last time.

There are matters that should receive your serious consideration. Annexed is a list of suggestions, if implemented will help to hold a free and fair election in the North and the East.

PRESIDENTIAL ELECTION CAMPAIGN - RANIL

My dear Leader of the Opposition,

PRESIDENTIAL ELECTION CAMPAIGN

I very earnestly appeal to both of you the main Presidential Candidates and to the Political Parties that back you to give top priority for the settlement of the Ethnic problem which is far more urgent and important than any other issue we are facing today. We have had enough loss of life and property and can’t afford to lose any more. Above all the people are living in constant fear and tension. No one wants things to go on like this indefinitely.

The Cease-fire Agreement (CFA) signed over 31/2 years back did not take us any where near the solution, but has helped only the L.T.T.E. to stabilize themselves in areas held by them and to bring under their control more areas held by the Government. The only consoling factor is that the war has stopped and that there are no more deaths at the battle front. But the killings go on unabated and the people in the L.T.T.E. held areas continue to live under the subjugation of the L.T.T.E. with no hopes of being liberated by the Government. No one seems to bother about the hundreds of thousands illegally held under the L.T.T.E. dictatorship for several years, with no hopes of redemption in the near future. Further delay will only help the L.T.T.E. to gain legitimacy of their possession.

The people belonging to all sections want an early solution to the Ethnic problem and end of the war once and for all. When everyone knows what our problem is and also what the solution is, there is no need for further discussion. Our experience has taught us that in our country all the promises made during elections are hard to implement after the elections mainly due to the pressure from the opposition side and the interested parties. There is no guarantee that the ethnic problem that had been dragging on from 1956 will be solved after the forthcoming Presidential Elections of 2005. There is no guarantee that what happened at the April, 2004 General Election will not be repeated and a free and fair election will be held in the North and the East.

The L.T.T.E. will never be accepted as the sole representatives of the Tamils and so with the TNA Members of Parliament who are proxies of the L.T.T.E. The Muslims did not have any proper representation in any discussions with the L.T.T.E. There is every possibility of the Peace Process getting dragged on further with no solution found for an indefinite period of time. Hence if anybody is serious about finding a permanent solution to the ethnic problem, it should not form a part of the Presidential Election campaign and should be dealt with separately.

Experienced politicians will agree that the election campaign will ultimately take a bitter communal turn and will be centred on the ethnic issue. Such a campaign will revive communalism that is virtually dead. I do not accept that J.V.P. and J.H.U. as communal parties. Every party wants an early and a peacefull solution. I therefore plead with every Political Party involved in the campaign to give full pressure to the Candidates whom they are backing to take the ethnic issue out of the Presidential campaign and to announce a solution based on a Federal Structure within a United Sri Lanka. Also to assure the country that everyone whatever section one belongs to, will be treated as equals and enjoy all rights without any discrimination on any grounds.

The fear that a Federal Solution will end up in the division of the country is baseless. There are a number of countries in the world where federalism has thrived and all the citizens living in peace enjoying all rights like the others. Furthermore the Indian stand that it will not support the demand for separation should allay the fears of those who think that the country may divide into two. It is in Tamil Naad in Indian where the demand for separation originated fifty years back. Now no one talks about separation and people are living happily and leading a contended life. The Indian stand could be taken as a guarantee against separation whichever party comes to power in India.

Thousands of Sri Lankan Sinhalese, Tamils and Muslims and other ethnic groups visit India everyday. They are full of admiration for its liberal democratic ideals. A majority Hindu country has a great Muslim Scientist as Head of the State and treat him with due honour. Another highly respected Leader is the Prime Minister of India from an ethnic group that forms only 2% of its population and the Leader of ruling Party who is a very highly respected Lady is one not born in India. This great neighbour of ours has found Unity in Diversity; why can’t we?. Can’t we have powers devolved to our regions on the Indian Pattern?.

I strongly urge that both the candidates should declare that a solution to the ethnic problem will be found jointly, by both agreeing to take it up soon after the elections irrespective of who wins. I am positively sure that this is the only way to bring back peace to our suffering masses. With the attention of the entire International community focused on Sri Lanka, I belive this is the best time too.

My dear Prime Minister,

PRESIDENTIAL ELECTION CAMPAIGN

I very earnestly appeal to both of you the main Presidential Candidates and to the Political Parties that back you to give top priority for the settlement of the Ethnic problem which is far more urgent and important than any other issue we are facing today. We have had enough loss of life and property and can’t afford to lose any more. Above all the people are living in constant fear and tension. No one wants things to go on like this indefinitely.

The Cease-fire Agreement (CFA) signed over 3 1/2 years back did not take us any where near the solution, but has helped only the L.T.T.E. to stabilize themselves in areas held by them and to bring under their control more areas held by the Government. The only consoling factor is that the war has stopped and that there are no more deaths at the battle front. But the killings go on unabated and the people in the L.T.T.E. held areas continue to live under the subjugation of the L.T.T.E. with no hopes of being liberated by the Government. No one seems to bother about the hundreds of thousands illegally held under the L.T.T.E. dictatorship for several years, with no hopes of redemption in the near future. Further delay will only help the L.T.T.E. to gain legitimacy of their possession.

The people belonging to all sections want an early solution to the Ethnic problem and end of the war once and for all. When everyone knows what our problem is and also what the solution is, there is no need for further discussion. Our experience has taught us that in our country all the promises made during elections are hard to implement after the elections mainly due to the pressure from the opposition side and the interested parties. There is no guarantee that the ethnic problem that had been dragging on from 1956 will be solved after the forthcoming Presidential Elections of 2005. There is no guarantee that what happened at the April, 2004 General Election will not be repeated and a free and fair election will be held in the North and the East.

The L.T.T.E. will never be accepted as the sole representatives of the Tamils and so with the TNA Members of Parliament who are proxies of the L.T.T.E. The Muslims did not have any proper representation in any discussions with the L.T.T.E. There is every possibility of the Peace Process getting dragged on further with no solution found for an indefinite period of time. Hence if anybody is serious about finding a permanent solution to the ethnic problem, it should not form a part of the Presidential Election campaign and should be dealt with separately.

Experienced politicians will agree that the election campaign will ultimately take a bitter communal turn and will be centred on the ethnic issue. Such a campaign will revive communalism that is virtually dead. I do not accept that J.V.P. and J.H.U. as communal parties. Every party wants an early and a peacefull solution. I therefore plead with every Political Party involved in the campaign to give full pressure to the Candidates whom they are backing to take the ethnic issue out of the Presidential campaign and to announce a solution based on a Federal Structure within a United Sri Lanka. Also to assure the country that everyone whatever section one belongs to, will be treated as equals and enjoy all rights without any discrimination on any grounds.

The fear that a Federal Solution will end up in the division of the country is baseless. There are a number of countries in the world where federalism has thrived and all the citizens living in peace enjoying all rights like the others. Furthermore the Indian stand that it will not support the demand for separation should allay the fears of those who think that the country may divide into two. It is in Tamil Naad in Indian where the demand for separation originated fifty years back. Now no one talks about separation and people are living happily and leading a contended life. The Indian stand could be taken as a guarantee against separation whichever party comes to power in India.

Thousands of Sri Lankan Sinhalese, Tamils and Muslims and other ethnic groups visit India everyday. They are full of admiration for its liberal democratic ideals. A majority Hindu country has a great Muslim Scientist as Head of the State and treat him with due honour. Another highly respected Leader is the Prime Minister of India from an ethnic group that forms only 2% of its population and the Leader of ruling Party who is a very highly respected Lady is one not born in India. விடுதலைப் புலிகளுடனான பேச்சுவார்த்தை

விடுதலைப்புலிகள் அரசுடன் நிபந்தனையற்ற பேச்சு வார்த்தையை மீண்டும் ஆரம்பிக்க இருப்பதாகவும் அரசு அதற்குரிய ஆயத்தங்களை செய்வதாகவும் அறிகிறேன் இச்செய்தி சர்வ தேச சமூகம் உட்பட அனைவருக்கும் மகிழ்ச்சி தருவதாக இருப்பினும் எனது அபிப்பிராயத்தின் படி வெளிவிவகார அமைச்சர் லக்ஸ்மன் கதிர்காமரை விடுதலைப்புலிகள் தான் கொலை செய்தனர் என்ற குற்றச் சாட்டிலிருந்து அவர்கள் விடுவிக்கப்பட்டுள்ளனர் என விமர்சிக்கப்படலாம். ஆகவே இப் பேச்சுவார்த்தை ஆரம்பிப்பதற்கு முன்பு சில முக்கியவிடயங்கள் பேசித் தீர்க்கப்படாமை நியாயமற்ற செயலாகும். பேச்சுவார்த்தைக்கு முன் தீர்க்கப்பட வேண்டிய சில விடயங்கள் பின்வருமாறு:

அமைச்சர் திரு. கதிர்காமரின் கொலைக்கும் தமக்கும் எதுவித சம்பந்தமும் இல்லையென்று விடுதலைப்புலிகள் வழமைபோல் மறுத்துள்ளனர்.இவர்கள் தினமும் தமக்கு எதிர்ரானவர்களையோ அல்லது அரசாங்க உளவுத்துறையினர் ஒருவரையோ கொலை செய்து வருகின்றனர். சர்வதேச சமூகத்தின் கண்டணங்களையும் பொருட்படுத்தாது தொடரும் விடுதலைப்புலிகளின் கொலைகள் மேலும் தொடராது என்ற வாக்குறுதியைப் பெற்ற பின்பே பேச்சுவார்த்தையை தொடர வேண்டும்.

உலகளாவிய கண்டணங்களையும் மீறி ஏழைப்பிள்ளைகளையும் மற்றும் சுனாமியால் பாதிகப்பட்டோரின் பிள்ளைகளையும் கட்டாயத்தின் பேரில் புலிகள் போராளிகளாகச் சேர்த்துக் கொண்டிருக்கிறார்கள். தமிழ் தேசிய கூட்டமைப்பு பாராளுமன்ற உறுப்பினர்கள் கூட இதை ஆட்சேபிக்காத பட்சத்தில் புலிகள் சிறுவர்களை தமது படையில் சேர்த்து கொள்ளப் போவதில்லையென உத்தரவாதம் தராதவிடத்து அரசு பேச்சுவார்த்தைக்கு போவது என்பது மிக கொடூருமான செயலாகும்.

புலம் பெயர்ந்து வாழும் தமிழர்கள் உறவினர்களைச் சந்திப்பதற்கு நாடு திரும்பும் போது பிற நாட்டில் வாழ்ந்த காலப்பகுதிக்கு நாளொன்றிற்கு ஒரு பவுண் அல்லது அதற்கு சமமான பணத்தை வரியாக செலுத்தும்படி வற்புறுத்துகின்றனர். இந்த நடவடிக்கையை கைவிடு வதாக சம்மதிக்கும் வரை பேச்சு வார்த்தை ஆரம்பிக்கபடக் கூடாது.

அரச கட்டுப்பாட்டுப் பகுதிகளில் உள்ள மாவட்ட நிர்வாகத்தில் தலையிடுவதை நிறுத்தி அரச ஊழியர்கள் சுதந்திரமாக செயற்படவிடுவதற்கு உத்தரவாதம் தரும் வரை பேச்சு வார்த்தை ஆரம்பிக்கபடக் கூடாது.

விடுதலைப்புலிகளின் கட்டுப்பாட்டுப் பகுதியில் தடுப்பு முகாம்கள் சித்திரைவதை முகாம்கள் இருட்டறை மறியல்சாலைகள் போன்றவற்றில் பலர் மனித உரிமைகள் மீறப்பட்ட முறையில் சித்திரவதைக்கு ஆளாக்கப்படுகின்றனர். அனுசரணையாளர்களே இரும்புத்திரை என்று வர்ணிக்கப்படுகின்ற இப்பகுதிக்குப் போவது தடுக்கப்பட்டுள்ளமையால் பேச்சு வார்த்தை ஆரம்பிப்பதற்கு முன்பு சர்வதேச சமூகப் பிரதிநிதிகளோ அல்லது சர்வதேச மன்னிப்புச் சபை உறுப்பினர்களோ அல்லது மனித உரிமை அமைப்புகளோ சென்று இப்பகுதிகளை பார்வையிட விடுதலைப்புலிகள் அனுமதிக்க வேண்டும்.

யுத்த நிறுத்த ஒப்பந்தம் அரச கட்டுப்பாட்டுப் பகுதிக்கு விடுதலைப்புலிகளின் பிரவேசம் அரசியல் பணிகளுக்காகவே அனுமதிக்கப்பட்டது.ஆனால் அரசியற் பணியைத்தவிர தம் இஸ்டம் போல் விடுதலைப் புலிகள் செயற்படுகின்றனர். அரசியற் பணியை மட்டும் செய்வோம் என்றும் பொது மக்களின் சக வாழ்வில் தலையிட மாட்டோம் என்றும் விடுதலைப் புலிகள் உத்தரவாதம் வழங்கும் வரை பேச்சு வார்த்தை ஆரம்பிக்கப்படக் கூடாது.

மூன்றரை ஆண்டுகளுக்கு முன்பு யுத்த நிறுத்த ஒப்பந்தம் செய்யப்பட்டு இன்று வரை எதுவித முன்னேற்றமும் காணப்படவில்லை. ஆனால் இவ் யுத்த நிறுத்தம் அரசுகட்டுப்பாட்டுப் பகுதியை பெருமளவு தம் கட்டுப்பாட்டின் கீழ் கொண்டு வரவும் தமது கட்டுப்பாட்டு பகுதியில் தாம் ஏற்படுத்திய சர்வதிகார ஆட்சிக்கு சட்ட அதிகாரம் பெறவுமே உதவியது. ஆகவே பழைய யுத்த நிறுத்த ஒப்பந்தத்தை இரத்து செய்து காலவரையறை விதித்து புதியதோர் ஒப்பந்தம் செய்தல் அவசியமாகும்.

இறுதியாக விடுதலைப்புலிகளின் நடவடிக்கைகளை சர்வதேச சமூகமும் நன்கறிந்துள்ளது என சுட்டி காட்ட விரும்புகிறேன். தாம் செய்த கொலைகளை, குறிப்பாக வெளிவிவகார அமைச்சர் கதிர்காமரின் கொலையால் தமக்கு ஏற்பட்ட பெரும் பின்னடைவை சமாளிக்க இந்த சந்தர்ப்பத்தை விடுதலைப் புலிகள் பாவிக்க அனுமதிக்கக் கூடாது. தயவு செய்து எனது வேண்டுகோளை கருத்திற் கொண்டு விடுதலைப் புலிகளால் சொல்லமுடியாத துன்பத்தை அனுபவித்துவரும் அப்பாவி தமிழ் மக்களுக்கு ஒரு நல்ல தீர்வை ஏற்படுத்திக் கொடுக்குமாறு வேண்டுகிறேன்.

Resumption of talks with the LTTE

I understand that the LTTE has agreed to re-start talks without pre-conditions and that the government is also preparing for it. Although it is welcome news for all including the international community. I am of the opinion that commencing talks immediately could be interpreted as if the LTTE had been exonerated from the charge of assassinating Hon. Lakshman Kadirgamar. It will be very unfair to start talks without sorting out certain burning issues some of which are listed below.

The LTTE as usual has vehemently denied any involvement in the assassination of Hon. Lakshman Kadirgamar Minister of Foreign affairs. Hardly one day passes without at least one person either a political opponent or an officer from the intelligence unit getting killed by the LTTE. The killings go on unabated and even in spite of the condemnation of the international community. It will be treacherous if the government commences talks with the LTTE without an undertaking from them that they will stop killings.

In spite of the worldwide condemnation the LTTE continues to conscript children as child soldiers from among poor families and Tsunami victims. Since no protests are forth coming even from TNA members of parliament, it will be more treacherous if the government commences talks without any assurance from the LTTE to stop consumption forth with.

The Tamil ex-patriots who visit their relations and friends are being compelled to pay them at the rate of one pound or its equivalent per day for everyday they lived out side Sri Lanka. Until the LTTE agrees to stop this, talks should not commence with the LTTE.

Before the commencement of talks with the LTTE, the LTTE should give an undertaking that they will not interfere with the Administration of the Districts that are under the control of the government and that the officers will be permitted to work independently.

It is believed that there are detention camps, torture camps and darkroom prisons where people are kept, denied of their fundamental and human rights. Since even the facilitators have no access to these areas described as iron curtain areas, the LTTE should before the commencement of talks agree to allow a team of representatives of the International community or Amnesty International or Human rights organisation to inspect the areas under their control

The cease fire agreement (CFA) enabled the LTTE to get into government held areas to do only political work. But they do any thing and everything other than politician work. The LTTE should give an assurance that they will do only political work and not interfere with the normal life of the people in the areas held by the government.

Three and a half years had passed since the signing of the CFA without any treacherous. But the CFA had helped the LTTE to gain partial central of the government held areas and to legitimise their dictatorial rule in the areas held by them, it has therefore become necessary to do away with the present CFA and sign a CFA. The core issues should be taken up for discussion based on the final solution to the problem. In the event of establishing an interim administration all political parties should find representation. The LTTE should give up arms and seek government serenity if required.

In conclusion may I point out to you that the LTTE’s peace conduct is very well known to the International community. They should not use this opportunity as a play to get over the massive set back caused to them due to the recent assassination especially that of Hon. Lakshman Kadirgamar, which was spurned by the international community.

Please give serious consideration to my suggestions which will give some relief to the Tamils who are under going severe hardship under the LTTE’s rule.

முன்னாள் தமிழர் விடுதலைக் கூட்டணி பாராளுமன்ற உறுப்பிpனரும் ஜனாதிபதி சட்டத்தரணியும் சட்டமாமேதையுமான அமரர் கலாநிதி நிலன் திருச்செல்வம் அவர்களின் 6வது நினைவு தினம்.

தமிழர்களின் விடிவிற்காக தனது மதி நுட்பத்தால் சகலராலும் ஏற்றுக்கொள்ளத்தக்க ஒரு அரசியல் சாசனம் ஒன்றை உருவாக்கிய சட்டமாமேதை அமரர் கலாநிதி நிலன் திருச்செல்வம் அவர்களின் 6வது நினைவு தினம் இனறு 29.07.2005 எமது கழகத்தால் விடுதலைக் கூட்டணி தலைமைச் செயலகத்தில் காலை 9.30 மணியளவில் அனுஷ்டிக்கப்பட்டது. தமிழர் விடுதலைக் கூட்டணி உறுப்பினர்களும் மற்றும் அன்னாரின் நெருங்கிய நண்பர்களும் கலந்து கொண்டு அமரரின் உருவப் படத்திற்கு மலர் மாலை அணிவித்து அஞ்சலி செலுத்தினார்கள்.

எமது கழகத்தின் உப தலைவர் திரு. க. சிவராசா தனது உரையில் உலகத் தலைவர்களால் நன்கு மதிக்கப்பட்டவரும் தலைசிறந்த சட்ட மேதையுமான கலாநிதி நிலன் இன்று உயிருடன் இருந்திருந்தால் தனது மதி நுட்பத்தால் சர்வதேச சமூகத்தின் ஒத்துழைப்புடன் இலங்கை அரசிற்கு அழுத்தத்தை கொடுத்து இனப்பிரச்சினைக்கு நிரந்தர திர்வைக் கண்டிருப்பார். இந்த விடயம் அன்னாரை கொலை செய்ய ஆணையிட்டவர்களுக்கே நன்கு தெரியும். ஆதனால்தான் கலாநிதி நிலன் திருச்செல்வம் அவர்களால் உருவாக்கப்பட்ட அரசியல் அமைப்புதான் இலங்கைக்கு சிறந்தது என தங்களின் ஒரு பத்திரிக்கையாளர் மாநாட்டில் அவர்களே கூறினார்கள். அந்த அளவிற்கு அவரின் மதிநுட்பம் சிறந்திருந்தது எனக்குறிப்பிட்டார்.

அன்னாரின் நண்பர் திரு. மு.ஆனந்தராஜா சட்டத்தரணி தமதுரையில் அமரர் நிலனின் எளிமையை குறிப்பிட்டார். சர்வதேச சமுகத்தால் மதிக்கப்பட்ட அப்பெருமகன் எல்லோரிடமும் மிகவும் எளிமையாகவும் பண்பாகவும் பழகிய ஒர் உயர்ந்த இலட்சியவாதி எனக் குறிப்பிட்டார். நேற்று அரசியலுக்கு வந்துவிட்டு ஏதோ வானத்தில் இருந்து குதித்தவர்கள்போல் நடந்து கொள்பவர்கள்தமது ஆணவத்தை கைவிட்டு அமரரின் எளிமையை எண்ணிப்பார்த்து நடந்து கொள்ள வேண்டும் எனவும் கேட்டுக் கொண்டார்.

தொடர்ந்து எமது கழக உறுப்பினர் திரு. க.சண்முகலிங்கம் தமதுரையில் அமரர் அமிர்தலிங்கம் அமரர் கலாநிதி நிலன் திருச்செல்வம் ஆகியோரின் மறைவால் ஏற்பட்ட பாராளுமன்ற உறுப்பினர் பதவியை பெற்றுக் கொண்டு தமது குடும்பத்தை வளப்படுத்தியவர் கூட அமரர்களின் பெயரை உச்சரிக்கக்கூட திராணியற்று கூணிக் குறுகிப் போயுள்ளார் என வேதனையுடன் குறிப்பிட்டார். அத்துடன் தமிழ் மக்களின நலனில் அக்கறை கொண்டவர்கள் எவரும் அவர்களை கொலை செய்யத் துணியமாட்டார்கள் எனவும் குறிப்பட்டார்.

மேலும் பலர் தங்களதுரையில் அமரர் கலாநிதி நிலன் திருச்செல்வம் அவர்களின் செயற்பாடுகளுக்கு உலகத் தமிழினமும் தமிழர் விடுதலைக் கூட்டணியும் என்றுமே தலை சாய்த்து வணங்கிக் கொண்டேயிருக்குமென குறிப்பிட்டனர்.

பிற் பகல் 12.15 மணியளவில் அஞ்சலி நிகழ்வு நிறைவடைந்தது.

தமிழர்களின் தலைவன் மாபெரும் வரலாற்றின் மனிதன் இணைந்ந வட கிழக்கு மாகாணத்தை உருவாக்கிய சிற்பி அமரர் அ.அமிர்தலிங்கம் அவர்களின் 15வது நினைவு தினம் - 13. 07. 2005.

அமரர் அமிர்தலிங்கம் அமரர் யோகேஸ்வரன் ஆகியோரின் நினைவு தினம் இன்று 13.07.2005 எமது கழகத்தால் தமிழர் விடுதலைக் கூட்டணி தலைமைச் செயலகத்தில் காலை 10.00 மணியளவில் அனுஷ்டிக்கப்பட்டது. தமிழர் விடுதலைக் கூட்டணி உறுப்பினர்கள் பெருமளவில் கலந்து கொண்டு அமரர்களின் உருவப்படத்திற்கு மலர் மாலை அணிவித்து அஞ்சலி செலுத்தினார்கள்.

எமது கழக உறுப்பினர் திரு. க. சண்முகலிங்கம் தனது உரையில் 1987ம் ஆண்டு இலங்கை இந்திய ஒப்பந்தத்தை ஏற்படுத்தி இணைந்த வடகிழக்கு மாகாணத்திலேயே திர்வு வேண்டுமென விடாப்பிடியாக நின்று அன்றைய பிரதமர் மறைந்த ரா_வ் காந்தியிடம் வலியுறுத்தி இணைந்த வடகிழக்கு மாகாணத்தை உருவாக்கினார். அந்த ஒப்பந்தம் மட்டும் இன்று செயற்பாட்டில் இருந்திருக்குமேயானால் யாழ்ப்பாணத்தில் இருந்து வவுனியா மன்னார் திருகோணமலை மட்டக்களப்பு அம்பாறை என வட கிழக்கு மாகாணத்தின் அனைத்து இடங்களிலும் தமிழர்களின் ராஜ்ஜியம் பரந்து விரிந்திருக்கும். துரதிஷ்ட வசமாக ஒரு சிலர் அதை குறை கூறியதால் இன்று தமிழர் நிலப்பரப்பின் எல்லைகள் மிகவும் சுருங்கிக் கொண்டே போகின்றது. இந்த வரலாற்றுத் தவறை செய்தவர்கள் நிச்சயம் ஒருநாள் உணரத்தான் செய்வார்கள். அமரர் அமிரின் கனவு நனவாகியிருந்தால் இணைந்த வட கிழக்கு மாகாணத்தில் தமிழர்கள் தலை நிமிர்ந்து வாழ்ந்திருப்பார்கள். அமரர் அமிர்தலிங்கத்தின் அரசியல் வாரிசுகள் என்று சொன்னவர்கள் கூட இன்று வாய் மூடி மௌனிகளாகி தடம்மாறி போய்விட்டார்கள் பாவம் அவர்கள் பரிதாபத்திற்கு உரியவர்களாகிவிட்டார்கள். அமரர் அமிர்தலிங்கம் அவர்களின் அரசியல் செயற்பாட்டில் எவரும் குற்றம் காணமுடியாது. அந்தளவிற்கு அவர் தியாக சிந்தையுடன் தன்னை அர்ப்பணித்துக் கொண்டார். சிங்கள பேரினவாதிகளுக்கு அமிர் ஒரு சிம்ம சொப்பனமாகவேத் திகழ்ந்தார் அன்னாரின் அகால மரணம் தமிழ் மக்கள் நலனில் அக்கறை கொண்டவர்களால நிகழ்த்தப்பட்டிருக்க முடியாது.

அமரர் அமிரின் செயற்பாடுகளுக்கு உலகத் தமிழினமும் தமிழர் விடுதலைக் கூட்டணியும் என்றுமே தலை சாய்த்து வணங்கிக் கொண்டேயிருக்கும் என்று குறிப்பிட்டார்.

The Peace Process and the Fundamental Rights of the Tamil People.

Please bear with me for this lengthy letter which I hope you will have the patience to read and take suitable action. Since I have to give certain details related to the issue, the letter had become lengthy for which I seek your pardon.

When the Norwegian special representative Mr. Eric Solheim took up the responsibility of bringing the Government and the L.T.T.E to the negotiating table, to work out a satisfactory solution to the ethnic problem, everyone was very happy. Although Mr. Eric Solheim started his mission as a facilitator he gradually assumed the role of the mediator, which I welcomed. I am aware of the embarrassment he faced and of the obstacles that crossed his way. One day in Parliament the Speaker Hon. Anura Bandaranayake had to remind a member of the presence of Mr.Solheim in the gallery, when that member made a speech slandering Mr.Solheim. Since the front benchers failed to defend him I, from the opposition, had to defend him and offer an apology on behalf of the country. I am now compelled to believe that Mr.Solheim is deviating from his mediatory role and acting in a partisan manner, favouring the L.T.T.E without any regard or consideration for the suffering Tamils. His role now appears to be detrimental to the Tamil cause, more related to the democratic and fundamental rights.

I am a Tamil senior citizen. I had been in active politics for well over 45 years and served as a Member of Parliament for about 17 years. I have a duty cast on me, when all the elected Tamil Members of Parliament from the North and the East and various N.G.Os have failed in their duty, to highlight the sufferings of the Tamil people in the provinces of the North and the East. Many Tamil voices had been silenced by the L.T.T.E’s guns. Even Heads of States of various countries are silent on this issue. I am duty bound, inspite of the risks I face, to bring to the notice of the International Community, through the respective Diplomatic Missions, the poor plight of the Tamil people in Sri Lanka and urge them to break their silence and express their views, without leaving the entire matter in the hands of a single or few individuals.

What the country wants today is peace. There is no doubt about it, but certainly not at any price. If we are going to achieve Peace only by surrendering all our fundamental, human and democratic rights to the L.T.T.E we do not want that Peace. What the Tamils want is peace with dignity and all their rights preserved. We want to live like any other Sri Lankan in the South of Sri Lanka.

For obvious reasons Members of Parliament from both the Government and the opposition come out with strong statements, off and on, praising the L.T.T.E without realising the ground situation in the areas held by the government and the L.T.T.E. In a statement made recently Mr. Eric Solheim too had boasted that three years of Cease fire has saved thousands of lives. It is true, but it has also deprived the Tamils of the North and the East of their fundamental and democratic rights.

Everyone is talking only about Peace and everyone wants to satisfy only the L.T.T.E by conceding all their demands. The latest addition to this list is the World Bank Country Director Mr. Peter Harrold who wants to release 06 Billion Rupees to the L.T.T.E recognizing it as a legitimate Stakeholder. This is a glaring example of the lack of knowledge of the ground situation. The World Bank is for the people and not for the L.T.T.E. unfortunately no one bothers about the Tamil people who are living under the subjugation of the L.T.T.E and weeping in silence. The Tamils need to be liberated from these so called liberators, the L.T.T.E before they are made Permanent Slaves of theirs. The Tamils never suffered like this, under any government, at any time. There was discrimination at one stage mainly in the fields of Education, Employment and Development. However they were not completely overlooked in these fields. In any case the Tamils enjoyed their democratic rights although there were violations of Human Rights and Fundamental rights, off and on, which are nothing compared to what is happening today, even in areas held by the Government which had been gradually taken over by the L.T.T.E, after the Cease Fire Agreement was signed with the Government. By allowing this the Government had made the biggest blunder, other one being allowing the L.T.T.E to levy taxes that pass through the A9 road and collecting toll from the users of that road.

In the good old days, the people could make their protests in any form and in any manner they wanted to. People had hartals, black flag demonstrations, protest meetings etc, but not under compulsion of anybody. As long as they were non-violent the Police looked on without any interference. We had an Independent Media. One could write or say, for or against, anything they liked.

I remember, when Hon. Mrs.Srimavo Bandaranayake the Prime Minister, at that time visited Jaffna to open the Jaffna University, a number of public meetings were held to condemn her policies. A massive Sathiyagraha was organised to protest against her visit. Yet she came and opened the University without any incidents. Not a single person who participated in that function was harmed or threatened by anybody. Our fundamental rights were not interfered with by any authority.

This is the type of freedom and democratic rights the people enjoyed in the past. The L.T.T.E cadre had been so brain-washed that they will not believe that the Tamils were so free and were never subjugated to the Sinhalese people or to anybody else.

What is happening today in Tamil areas is shocking. Our people can’t talk or write freely. They can’t do anything without the interference of the L.T.T.E cadre. There are a handful of fictitious organisations representing various trades, unified under an umbrella organisation calling itself the Federation of People’s Organisations.They derive their authority from the L.T.T.E Leadership. This organisation is made use of by the L.T.T.E for all their activities. Innocent school children are used in large numbers for demonstrations against the Government, backed by the L.T.T.E .When even educated leaders of some Political Parties do not properly understand the provisions of the Interim Self Governing Authority (ISGA) how can one expect these organisations and small school children to understand it. Yet instigated by the L.T.T.E they all demonstrate, demanding the ISGA as a prerequisite to re-start talks with the Government.

The Tamil people are now at the mercy of the L.T.T.E. I do not deny that successive Governments from May, 1972 had been very cruel towards the Tamil youths who had been actively involved in politics. Some times even innocent Tamil youths had become victims. There were some killings, long term detentions, torture etc. But today the L.T.T.E had broken all records as far as the killings and detentions of the Tamil youths are concerned. Recently, in Vavuniya, when a Member of the Sri Lanka Monitoring Mission wanted to visit a youth belonging to another group detained by the L.T.T.E, he was held by the neck and pushed out of the L.T.T.E’s political office. This is not the type of Political activity for which provision was made in the Cease Fire Agreement (CFA).

Apart from those who had the means to flee the country, thousands of Tamil youths belonging to other armed groups had been killed mercilessly by the L.T.T.E. There had been abductions with no trace of the abducted. Even after the cease fire agreement had been signed, many Tamil youths belonging to other groups had been killed, accused of giving information to the Army. What is the type of information one could give against the L.T.T.E when they have easy access to any part of the country, in any number. Many Politicians, Heads of Schools, Academics, Lawyers, Journalists top ranking Government Servants, Government Agents etc., were killed by the L.T.T.E .It should be noted that not a single person in this category had ever been killed by the Sinhala forces. All these killings are among the Tamils and by the Tamils.

Of the nine provinces in Sri Lanka there is a larger concentration of Tamil population in the provinces of the North and the East. Each of these two provinces are divided into two sections, one under the control of the L.T.T.E and the other under the control of the Government. Before the Cease Fire Agreement was signed on 22.02.2002 between the Government and the L.T.T.E the parties to the agreement confined themselves strictly to the respective areas under their control. No one was allowed into the L.T.T.E held areas. Behind the L.T.T.E‘s “IRON CURTAIN” no one knows as to what is happening there. No information, about their activities, leaks out. Even a person like Mr. Eric Solheim has no access to their areas beyond their meeting point at Kilinochchi. Will Mr.Solheim give a guarantee to the International Community that every thing is o.k. behind the “Iron Curtain?” Is he in a position to give a guarantee that people in Vanni are leading a contended life? I am sure he can’t.

The most unfortunate situation is that in this 21st century-in this modern world- inspite of the presence of the United Nations, even long after slavery was abolished and with all countries, except a few enjoying full democratic rights, a group of people are kept like slaves by the very same people who claim to be the liberators of the Tamils.

This situation prevails only in Sri Lanka. Even three years after the Cease Fire Agreement was signed between the two, the situation has not changed at all. The irony is that the Government Machinery is functioning in all the L.T.T.E controlled areas, but strictly under the control of the L.T.T.E and limited only to the benefits received through the Government Machinery. The L.T.T.E is so strict about admitting anybody into their areas that a few months back when two soldiers strayed into their areas they were arrested and remanded by the L.T.T.E court. But these two were released after bargaining with the Government for the release of ten of their cadre in return for the Government’s two. Perhaps there is provision in their penal code for such release, but how these ten L.T.T.E suspects were released is not within my knowledge. There are a number of Tamil detenus detained for very trivial offence for long periods. But unfortunately there is no provision in our laws to release those youths unfairly detained for fair length of time.

A few days back when two soldiers strayed into the no man’s land from the defence line at Kilaly, the L.T.T.E fired at them, killing one and severely injuring the other. On the other hand, from the day the C.F.A came into force the L.T.T.E cadre started going into the areas held by the Government very freely, making use of the provisions in the agreement in batches of 50 during the first 30 days, another 50 during the next 30 days and any number after 90 days, to do political work. The only restriction imposed was that they should be unarmed. This provision was very cleverly manoeuvred to out-wit the Government. The Government failed to take into consideration that these area were recaptured from the L.T.T.E which held these areas for a long time. Today they are not only in the so called cleared areas, they can be found in every nook and corner of Sri Lanka.

Another provision agreed on was relating to the disarming of the other groups. The Government’s failure to get an assurance that the L.T.T.E’s arms will not be used against anyone resulted in hundreds, belonging to the other groups, getting killed. Before the C.F.A anyone could go to any area held by the Government. But today the L.T.T.E’s dominance all over, prevents others opposed to the L.T.T.E from going freely to any part of the area held by the Government in the North and the East.

A matter that should be condemned is the recruitment of small children by the L.T.T.E to their cadre. Even the Member of Parliament of the TNA who themselves have children had not protested to the L.T.T.E against this.

Civilians and school children are compelled by the L.T.T.E to take part in anti-Government demonstration, under threat. Demonstrations and hartals are organized by the L.T.T.E for trivial matters, merely to promote themselves. L.T.T.E is behind all hartals and demonstrations. In many cases the poor civilians become victims due to the L.T.T.E provoking the army. If an army vehicle meets with an accident, the civilians are incited to set fire to the vehicle. The L.T.T.E is going all out to provoke the army to precipitate communal riots.

Every L.T.T.E cadre is a leader. The people have to carry out the orders without questioning. The people live in constant fear and tension. Unfortunately the electronic and the print media do not say or write a word against the L.T.T.E. The Tamil media in foreign countries also are under the control of the L.T.T.E.

I have not given an exaggerated report of the prevailing situation in the North and the East. Much more could be said about the L.T.T.E. I humbly request the International Community to study the situation carefully and find out the ways and means of reaching the ordinary people in these areas to know the truth. It is not easy to get anything from them without strong assurance that strict secrecy would be maintained.

The L.T.T.E is trying to establish a dictatorship. They are not interested in finding a solution to the problem that will be acceptable to the Tamil people. They want a solution the way they want. Today they are in control of the North and the East. They dictate terms to the government officers who, from top to bottom, obey the orders of the L.T.T.E. Minister’s can’t visit even areas under the control of the Government. The Governor of the North - East was warned not to visit Jaffna. All the Tsunami relief had to be handed over to them. They have not allowed the 22 Members of Parliament to take part in any discussion with the President or with the Prime Minister about Tsunami relief. By their arrogance they have already deprived the Tsunami victims of their due share. The Tsunami victims will have to pick up the crumbs and the left overs, after all the requirement of others are met.

Off and on the L.T.T.E organises demonstrations and engage in provocative acts. They insist on hoisting their Tiger flag in every function in the cleared areas also. A number of people had died in accidents, in their areas. If by chance an army vehicle knocked down a person, they made capital out of it and organized hartals and demonstrations, at which throw stones to provoke the army. The conscription of children continues to take place. They do everything they want and any way they choose.

The time has now come for the International Community to tell the Tigers that they must now tame themselves or get tamed.

The Government of Sri Lanka has given in too much to the L.T.T.E to the detriment of the Tamil people. The interests of the Tamils were not considered at all. In the enxiety of bringing peace, the preservation of the rights of the Tamils is forgotten.

The Tamils will be satisfied with a Federal solution. The Indian type or any other model recommended by the International Community should be acceptable. I am positively sure that the International Community with the participation of our neighbour India can easily find a solution to the satisfaction of everybody. The responsibility of liberating the Tamils from the L.T.T.E is now in the hands of the International Community.

I strongly urge you your Excellency to persuade your Government also to get involved fully in finding a reasonable solution to the ethnic problem. If it is not now it will then be never.
